Abstract
Artificial intelligence(AI) has had great influence on a wide range of society, and the area of criminal law is never an exception. Clear understanding on AI is crucial prior to the consideration of the relationship between AI and criminal law and the determination of the means to face the problems stemmed from it. However, the misunderstandings of AI and its conceptual difficulties have hindered complete understanding for general public as well as legal professionals. Especially, it is required to dispel certain misunderstandings that one equates AI with a human brain and vague fear or excessive vigilance mainly based on cinematic fictions such as advent of strong AI and human being subjugated to it. Prejudice of AI’s heterogeneity is also required to reconsider because AI has high degree of homogeneity and fungibility. Our viewpoint should be put on the intersection of AI and criminal law through the correction of such misunderstandings and clear understanding of AI, and in turn, we can then consider a solution given by current criminal law against present problems caused by the activities of AI. Undoubtedly, study and progression of criminal law investigating AI must go on as the evolution of AI and society continues.
