인공지능 기술이 비약적으로 발전하면서 이를 향한 사회적 관심이 높아진다. 이에 발맞추어 사회의 다양한 영역에서 인공지능이 활용된다. 인공지능에 관한 관심은 정부에 의해 수행되는 행정 영역에서도 발견된다. 정부는 다양한 행정 영역에서 인공지능을 활용하기 위해 여러 가지 준비를 한다. 이에 필요한 법적 기초도 이미 마련하였다. 하지만 인공지능을 행정에 활용하는 것과 관련된 문제들이 모두 해결된 것은 아니다. 이에 관해 다양한 법이론적ㆍ행정법 도그마틱적ㆍ행정학적 문제들이 제기된다. 이러한 상황에서 이 글은 인공지능을 행정에 활용할 때 어떤 이론적 문제가 제기되는지 검토한 후 어떻게 이에 대처할 수 있는지 살펴본다. 다만 이 주제에 관해서는 그동안 자동화 또는 자동적 행정이라는 이름 아래 다양한 선행 연구가 이루어진 편이다. 이들 연구를 검토하면 상당히 설득력 있는 문제 제기와 해법을 제시하고 있음을 발견할 수 있다. 이에 이 글은 선행 연구에서 상대적으로 주목되지 않았던 이론적 문제, 특히 법사회학적 문제에 초점을 맞춘다. 특히 인간중심주의 행정의 관점에서 제기되는 비판에 주목한다. 그리고 이 문제에 대응하기 위해 이 글은 독일의 사회학자 루만이 정립한 체계이론의 관점을 일정 부분 원용한다. 이를 토대로 하여 인공지능을 활용하는 행정이 어떤 점에서 가능한지 논증한다.
Abstract
Today, as artificial intelligence technology develops rapidly, social interest in it increases. In line with this, artificial intelligence is used in various areas of society. Interest in artificial intelligence is also found in the administrative area carried out by the government. The government is making various preparations to utilize artificial intelligence in various administrative areas. The legal foundation necessary for this has already been established. However, not all problems related to using artificial intelligence in administration have been resolved. In relation to this, various legal theoretical, administrative law dogmatic, and administrative issues are raised. In this situation, this article examines what theoretical problems arise when using artificial intelligence in administration and then examines how to deal with them. However, on this topic, various prior studies have been conducted under the name of automation or automatic administration. As reviewing these studies, we can find that they raise quite persuasive problems and suggest solutions. For that reason, this article focuses on theoretical issues, especially legal and sociological issues, that have received relatively little attention in previous research. In particular, the author pays attention to theoretical critics raised from the perspective of human-centered administration. In addition, in order to respond to this problems, this article partly uses the perspective of systems theory established by German sociologist Niklas Luhmann. Based on this, this article argues how administration using artificial intelligence is possible.
