라오스에서의 한국법원 판결의 승인 및 집행

초록

라오스에서 외국 판결에 대한 승인, 집행과 관련한 법규로는 라오스 민사소송법(2012), 재판집행법(2021), 경제분쟁해결법(2018) 등이 있고, 외국법원의 판결의 승인 및 집행을 위한 사법공조에 관련한, 라오스와 외국과의 조약으로는 1998년에 체결된 라오스-베트남 조약, 1999년에 체결된 라오스-중국 조약이 있다. 이들 내용을 분석하여 연구한 결과, 라오스에 있어 외국 판결의 승인 및 집행과 관련하여 다음과 같은 결론을 도출할 수 있었다. 첫째, 라오스 민사소송법상에는 승인의 대상이 되는 외국 판결을 한 국가와 라오스가 함께 가입한 국제조약이 있는 경우, 그 조약에 따라 승인받을 수 있는 요건을 갖추고, 민사소송법 제362조 등에 의한 다른 요건의 검토에 따라 승인을 받을 수 있다. 둘째, 라오스와 양자간 조약의 체결이 되어있지 아니한 국가의 판결을 라오스 인민법원에 승인 신청할 경우, 라오스 민사소송법상 규범력있는 상호주의 원칙을 주장할 수 있는 근거 규정은 없다. 여기서 규범력이 있는 상호주의 원칙이라는 취지는 이러한 상호주의를 근거로 승인의 요건이 충족되었다고 주장하는 경우 라오스 법원을 기속할 만한 규정으로 작용하지 않는다는 점을 의미한다. 라오스 민사소송법 제360조에서는 외국 판결에 관한 일반적인 원칙을 정하면서, 상호주의에 유사한 언급이 있지만 이는 선언적인 의미에 그치고 있을 따름이다. 외국 판결의 승인을 위하여 법원에 제출해야 할 서류를 정한 동법 제364조에서는 라오스가 가입한 관계 국제조약을 법원에 제출해야 할 문서로 구체적으로 열거함으로써, 조약이 체결되지 아니한 국가의 판결에 관하여는 외국판결의 승인 절차에서 애초에 절차적으로 배제됨을 분명하게 하고 있다. 셋째, 라오스와 대한민국 간에는 현재로서는 외국 판결의 승인, 집행을 위한 양자간 조약이 체결되어 있지 않다. 이는 종래 대한민국이 많은 외국 국가들과 민사 및 상사 사법공조 조약을 체결하면서 외국 판결의 승인, 집행에 관한 사항을 그 내용에 넣지 않은 것과 달리, 장래 대한민국이 라오스와 사법공조 조약을 체결함에 있어서는 외국 판결의 승인, 집행에 관한 내용을 포함하여 조약을 체결하는 것이 현실적으로 필요하다는 점을 시사한다.

Abstract

Regulations regarding recognition and enforcement of foreign court judgments in Laos include Law on Civil Procedure(2012), Law on Judgment Enforcement(2021), Law on the Resolution of Economic Disputes(2018). Also there exist judicial assistance treaties on recognition and enforcement of foreign court judgments such as Treaty on Mutual Legal Assistance in Civil and Criminal Matters between the Socialist Republic of Viet Nam and the Lao People’s Democratic Republic(1998) and Treaty on Mutual Legal Assistance in Civil and Criminal Matters between Laos and China(1999). Based on the analysis of those regulations and treaties, the following conclusion can be drawn. First, if both Laos and the country in which the court judgment is the subject of recognition according to the Law on Civil Procedure are contracting parties to the international treaty, the judgment can be recognized on condition that it satisfies the requirement of the treaty for recognition and passes the review according to the Article 362 of the Law on Civil Procedure and etc. Second, for the court judgment in the country where the bilateral treaty is not signed, there is no regulation invoked for the binding principle of reciprocity based on the Law on Civil Procedure. It means Laos Court is not binding to recognition by the principle of reciprocity. Although there is a clause similar to the principle of reciprocity in the Article 360 of the Law on Civil Procedure which stipulates the general principle on the foreign court judgment, it does not go beyond the declaratory provision. By stating specifically the related international treaty to which Laos is contracted as a document required for the recognition of foreign court judgment at the Laos court at the Article 364 of the Law on Civil Procedure, it clarifies ab initio the exclusion of the foreign court judgment in the country where the treaty is not singed. Third, at present, no bilateral treaty between Laos and Korea exist regarding the recognition and enforcement of foreign court judgment. This implies that it is necessary from the practical point of view to include the provision on the recognition and enforcement of foreign court judgment in the future judicial mutual assistance treaty between Laos and Korea.
