남북경협사업과 투자분쟁의 해결

남북경협사업은 남북의 정치적 대립에도 불구하고 꾸준히 이어져 왔지만, 북한 당국의 조치로 인하여 투자자인 남한기업의 투자재산이 침해될 수 있는 위험이 상존하고 있고, 남북 당사자 사이의 상사분쟁의 발생이 예상되고 있다. 남북경협사업의 안정적인 발전을 위해서는 이러한 투자분쟁과 상사분쟁의 해결을 위한 법제도적 장치가 마련되어야 한다. 특히 남북경협사업과 관련한 투자분쟁에 관한 해결절차를 마련하는 것이 요구되고 있다. 이와 관련하여 남북 사이에 ‘투자보장에 관한 합의서’와 ‘상사분쟁해결절차에 관한 합의서’가 체결되어 있다. 현실적으로 남북의 법원의 소송을 통하여 분쟁을 해결하는 것은 실효적인 해결책이 되기 어렵다는 점에서 ‘상사분쟁해결절차에 관한 합의서’에서 정한 남북상사중재제도를 시급히 정비하여야 한다. 이는 남북경협사업이 남북관계의 악화에 영향을 받지 않고 지속적으로 추진될 수 있는 법제도적 기반이 될 것이다.
Abstract
Despite of conflicts between South and North Korea, Inter-Korean Economic Cooperation Projects continue steadily. But the risks of investment still exist, and commercial disputes between parties of two Koreans are expected to happen. Therefore the legal system to cope with the risk of infringement by the North Korean government to the investment properties of South Korean investor should be urgently established. In this connection two Koreas already signed the “Inter-Korean Agreement on the Protection of Investment” and “Inter-Korean Agreement on the Commercial Arbitration Procedure”. They provide that the investment disputes between investors of one Party and the other Party, and commercial disputes between private parties, should be resolved by arbitration of Commercial Arbitration Committee. Considering that investors of each Party hard to use any courts of other Party, it is urgently need to be established the Commercial Arbitration Procedure between South and North. It could be also the legal foundation that bring mutual benefits to each Party from solid progress of Inter-Korean Economic Cooperation Projects despite of political conflicts.
