Abstract

There has been a controversial issue concerning law school admission in Korea. It has been insisted that the admission process has failed to secure fairness. However, the concept of fairness in law school is too narrowly understood or misunderstood. In fact, fairness consists of formal and substantial aspects. The past bar exam system mainly focuses on formal aspects but the law school system is designed to pursue substantial fairness, which differentiate the law school system from the previous bar exam system. However, the Korean law school system has so far been failed to acquire substantial consequences in terms of substantial fairness; in particular Korean law schools has not fully secured diversity in their student profile. Most of all, the system failed to enjoy social consensus and trust. In this respect, we should recognize the concept of fairness in law school and reform the current system according to such a consensus.
