Abstract
While human beings enjoy various benefits from digital technologies, they can encounter several adverse effects including reverse discrimination between multinational and domestic companies, possible violation of competition laws by enterprises, privacy infringement, cyber security issues. To minimize these adverse effects, countries have come up with new regulatory measures to keep this situation under control and digital industries are struggling to expand internationally to secure new markets at the same time. However, there is no international norm that can harmonize these conflicts. In the last few decades, as multilateral discussions have been sluggish, digital trade rules have been agreed at the level of regional trade agreements. While non-trade issues such as consumer and personal information protection have been developed in the regional trade agreement, traditional trade issues such as non-discrimination principle have not been actively discussed. Recently, new norms such as cross-border transfer of data and prohibition of installation of local servers have been actively introduced in the regional trade agreements, instead of principle of non-discrimination. Principles of non-discrimination in the current regional trade agreements have several problems such as disagreement among countries, absence of its universal type, controversies on the market openness. It would be much more logical to discuss non-discrimination principle right after confirmation of the scope and definition of ‘digital trade’. Considering the unavoidable gap between speed of digital technologies and related norms, however, we cannot delay comprehensive discussion on non- discrimination principle based on the wide definition and scope of digital trade. In the first approach, we are able to embrace digital trade through active interpretation and application of existing GATT and GATS norms. Second approach is that we should clearly identify the areas that are difficult to comply with existing GATT and GATS norms and create and apply a new norms suitable for these areas. For the third approach, we should generate and actively regulate special rules that can prevail GATT and GATS norms. Among the above approaches, the last approach, ‘special rule creation method’, that actively apply special rules for digital trade to trade of goods and services, can be balanced with current trends.
