예술인복지법상 재정지원의 중단 및 배제에 관한 소고

예술인복지법은 20011년 11월 예술인의 지위 향상과 복지 증진을 위하여 제정되었으며, 예술인의 특수성을 반영한 실질적인 정책 및 지원이 미흡하다는 이유로 2013년 12월과 2016년 2월에 각각 두 차례 개정되어 오늘에 이르고 있다. 제1차 개정법에서는 현장에서 예술인들이 경험하게 되는 불공정한 법률관계를 개선하고자 이를 금지행위로 규정하고 이러한 금지행위가 적발되면 시정명령 및 과태료를 부과할 수 있도록 하였다. 제2차 개정법에서는 금지행위를 불공정행위로 용어를 변경하고 불공정행위에 대한 시정명령을 이행하지 않은 문화예술기획업자등에 대한 국고보조 등의 재정지원을 중단하거나 배제할 수 있도록 하였다. 본 논문은 재정지원의 중단 및 배제가 현실적으로 작용할 수 있는 법적 근거를 마련하는 것을 목적으로 작성되었다.
Abstract
The Artists' Welfare Act was enacted in 2011 to improve the legal status of artisans and to promote their welfare, which was revised twice in 2013 and 2016 respectively. The reason for these revisions is that the policies and support that reflect the specialties of the artist have not been substantive. In the first amendment, the unfair legal practice related to the arts practitioners is prohibited in the field, and when these prohibitions are detected, they are imposed a fine for default and correct orders. In the second amendment, the term “prohibition” was changed to “unfair”, and financial support such as “national aid” for cultural arts and designers who failed to fulfill the order of correcting unfair practices was canceled or excluded. This paper is intended to present a legal basis for the practical application of the suspension and the elimination of financial support.
