헌법상 모성보호의 한계와 성과 재생산 권리 보장을 위한 헌법 개정 방향

초록

헌법에서 재생산권 보장은 임신, 출산, 수유 또는 양육으로 이어지는 과정에서의 ‘모성보호’가 중심이 되고 있다. 모성보호 조항은 모든 사람의 전생애에 걸친 일련의 재생산 활동에서의 자유로운 결정권 보장보다는 어머니라는 지위와 역할을 기반으로 하는 ‘보호’의 방식을 취하고 있고, 보호조차도 국가의 의무나 권리성은 미약한 것으로 평가된다. 이 논문은 국제인권론에서 널리 통용되는 재생산권의 정의와 내용을 토대로 하여, 국가가 보장하여야 하는 성과 재생산 권리를 확인하고 이를 실현하기 위한 법적 방안을 마련하고자 하였다. 이를 위하여 1994년 ICPD 행동계획과 2019년 ICPD25 나이로비 정상회의를 통해 검토되고 확인된 성과 재생산 건강 및 권리(SRHR)의 정의와 내용을 분석하고(II), 헌법 제36조 2항 모성보호를 중심으로 하여 헌법상 재생산권 보장의 범위와 한계를 살폈으며 재생산권과 관련된 법률들의 변화와 현행법 내용의 의의 및 문제점을 분석하여 재생산권 보장을 위한 헌법 개정의 당위성을 이끌어내고자 하였다(III). 다음으로 외국 헌법의 입법례와 그간 제안된 주요 개헌안을 검토하였다. 외국 입법례는 ‘어머니 보호’ 또는 ‘모의 권리’를 정한 사례들과 더불어 헌법에 성과 재생산 건강 및 가족계획의 권리 를 명시한 사례까지 검토하여, 개헌안 마련에 참고하였다(IV). 마지막으로 이상의 분석 결과를 토대로, 성과 재생산 권리를 보장하기 위한 헌법 개정 방안을 도출하였다(V).

Abstract

The protection of maternity during the process of pregnancy, delivery and breast-feeding or nurture lies at the center of assurance on reproductive rights in Korean Constitution. The ‘maternity protection’ clause adopts the form of ‘protection’ based on the social status and role of a mother rather than to assure the right of free decision along the series of reproductive activities throughout life, and even this protection is evaluated to be weak in the nation’s duties or the degree of the rights. This thesis, based on the definition and content of reproductive rights that has wide currency in the international human rights discourse, seeks to confirm the sexual and reproductive rights that the nation should assure and to provide a legal measure to realize it. For this, I have analyzed the definition and content of sexual and reproductive health & rights (SRHR) reviewed and confirmed by Programme of Action of the International Conference on Population and Development (ICPD PoA) in 1994 and the Nairobi Summit on ICPD25 in 2019(II), looked into the range and limits of the constitutional assurance of reproductive rights centering around maternity protection specified in Article 36, Section 2 of the Constitution, and sought to derive imperativeness for assurance of reproductive rights by analyzing the change in the laws concerning reproductive rights and the significance and problems of the current laws(III). Next, I reviewed the legislation cases of foreign constitutions and the major constitutional amendments proposed until now. I reviewed cases that specified clauses concerning sexual and reproductive health and family planning in constitution as well as cases that defined ‘maternity protection’ or ‘mothers’ rights’, and referred to those cases while arranging my constitutional amendment(IV). Based on the analysis results above, I arrived at a bill for constitutional amendment to assure sexual and reproductive rights(V).
