Abstract

Article 9 of the European Convention on Human Rights guarantees freedom of religion and is interpreted to include freedom to wear a head scarf according to religious beliefs. Nevertheless, in Europe, the question of how far religious attire should be allowed or prohibited has been a topic of socio-political and legal dispute for quite some time. In 2014, the European Court of Human Rights dealt with the ban on facial veils to cover the face in public in the case of S.A.S. v. France, and in 2005, Leyla Şahin v. Turkey is an example of a ban on Muslims from wearing head scarves on university campuses. Although the two cases have a time difference of about 9 years, they deal with a similar issue of whether the ban on Muslim clothing can be protected under Article 9 of the European Convention on Human Rights. Analysis on the two judgements show how the European Court of Human Rights has changed the attitude regarding the clothing of Muslim women, whether there has been any progress in relation to the religious freedom of Muslim women, or whether Islamophobia remains unchanged in Europe. The European Court of Human Rights used the expression of 'living together' as if it were pursuing the pluralism, tolerance, and openness that a democratic society pursues. However, to pursue those democratic values, society should embrace them instead of excluding women who want to wear certain religious clothing. Differences should be recognized and embraced in democratic society. Therefore, the ECtHR decisions of justifying the bans on religious clothing are interpreted as 'selective pluralism' or 'restricted tolerance' rather than 'inclusive pluralism'. The critical analysis of the ECtHR cases imply how Korean courts should deal with freedom of religion concerning hatred of certain minority religion in Korean society.
