책임의 분류와 유기적 이해

이 글에서는 책임을 개념, 구조항, 성질에 따라 분류를 시도하고, 이에 기초하여 책임 전체를 유기적으로 이해할 수 있는 바른 관점은 무엇인가라는 문제를 검토하였다. 먼저 책임이라는 단어는 여러 의미로 사용되는데, 이를 크게 유책, 부책, 행책으로 구분하였다. 유책으로서의 책임은 넓은 의미로는 규범 위반 행위가 존재하고 그에 대한비난을 행위자에게 돌릴 수 있음을 의미하고, 좁은 의미로는 규범 위반 행위에 대한비난을 행위자에게 돌릴 수 있는 행위자의 주관적 조건이 존재함을 의미한다. 부책으로서의 책임은 일차적으로는 과거의 규범 위반 행위와 관련하여 받게 되는 부담 가능성을 의미하고, 이차적으로는 일차적 부책의 결과로서 뒤따르는 부담 그 자체를 의미한다. 마지막으로 행책으로서의 책임은 입장이나 지위, 또는 역할에 따라 수행이 요구되는 일 또는 과업을 포괄적으로 지칭할 때 사용된다. 한편 책임의 구조를 형성하는 항으로서 답책자, 문책자, 책임 대상, 책임 이유, 책임부담, 책임 규범 등에 따라 다양하게 책임이 분류될 수 있고, 이런 구조 항들이 일정한 방식으로 결합하여 도덕적 책임, 법적 책임, 정치적 책임 등 고유한 책임 영역을형성한다. 그리고 성질에 따라 사전책임과 사후책임, 미래 지향적 책임과 과거 지향적책임, 적극적 책임과 소극적 책임, 작위 책임과 부작위 책임 등으로 분류하는 것이 가능하다. 마지막으로 책임의 본질을 행위의 정당성을 둘러싼 문답으로 이해하는 응답책임론의 입장에 설 때 다양한 책임 개념과 구조항들이 가장 일관되게 해명될 수 있음을밝히고자 했다.
Abstract
The Korean word ‘chaek-im’(responsibility) is used in different meanings which I respectively name blameworthiness-responsibility, liability-responsibility, role-responsibility, and pseudo-responsibility. The concept of blameworthiness-responsibility refers to the blameworthiness on the actor in relation to an act or its outcome, the concept of liability-responsibility the potential occurrence of a burden, or the burden itself, in relation to a past norm-violating act, and the concept of role-responsibility a kind of task asked for as a norm. Each concept can be classified into sub-meanings. Also responsibility can be classified in various ways according to subject, addressee, object, sanction, reason, norm, etc., which are the basic elements of the structure of responsibility, as well as according to the nature, for example, pre-event responsibility v. post-event responsibility, backward-looking responsibility v. forward-looking responsibility, and positive responsibility v. negative responsibility, etc. Lastly, I propose response-based theory of responsibility, which, I think, can give the most coherent understanding of the various concepts and structure-comprising elements of responsibility.
