Abstract

The Korean capital market faces significant challenges to its credibility due to recurring incidents of unfair trading and fraudulent schemes. Cases such as the 2023 “La Deok-yeon Scandal”, involving stock price manipulation, have inflicted substantial harm on numerous individual investors. In response, financial authorities have intensified penalties and sanctions against unfair trading practices. However, fines imposed under these measures are absorbed by the state, failing to directly compensate victims for their losses. Furthermore, private remedies, such as civil litigation and dispute resolution, are often ineffective due to procedural and financial burdens, leaving many individual investors unable or unwilling to pursue recovery. In contrast, other jurisdictions have implemented public compensation systems to address investor damages. The Fair Fund in the United States redistributes fines and disgorged profits directly to victims, while Taiwan’s Investors Protection Center offers legal assistance and representation in class actions, providing comprehensive compensation services. These examples demonstrate the practical feasibility of compensating victims through public law enforcement mechanisms. In Korea, discussions are necessary to explore utilizing fines to compensate victims or establishing a public investor protection institution inspired by the cases of the United States and Taiwan. Considering the limitations of fines in fully addressing damages, it is essential to evaluate roles such as the institution filing damage compensation lawsuits on behalf of victims. However, to prevent excessive interference by public institutions in corporate management, the institution’s roles and scope of compensation must be carefully defined. This paper analyzes the cases of the United States and Taiwan to examine the challenges in developing a public investor compensation system tailored to Korea’s capital market environment and proposes directions for its institutional design. Through ongoing discussions, an integrated and systematic compensation framework should be established to ensure that investors receive timely and effective protection. Such advancements will restore trust in Korea’s capital market, build a foundation for sustainable growth, and support the market’s continued development.
