성범죄 피해 아동의 진술조서에 대한 증거능력 및 증명력

초록

성(性)과 관련된 범죄는 세월이 흐르더라도 항상 문제가 되고 있고, 국가 및 사회에서 문제라고 항상 언급하면서 대책을 마련한다고 하지만 끊임없이 발생하는 범죄 중 하나이다. 성범죄 사건은 그 피해자가 남녀노소인지를 불문하고 문제가 된다고 할 수 있는데, 이 중에서도 가장 문제가 되는 것은 아동을 대상으로 한 성범죄라고 할 수 있다. 여기에는 성인도 아닌 어린 아동에게 어떻게 그러한 행위를 할 수 있는가 하는 인간으로서의 정서적인 부분이 영향을 미치고 있다고도 할 수 있다. 아동을 대상으로 한 성범죄 사건의 가장 큰 문제이면서 쟁점이라고 할 수 있는 부분은 재판에서라고 할 수 있다. 본 논문에서 다루고 있는 대상판례에서와 같이 아동의 진술조서에 대해 증거능력 및 증명력을 인정하지 않는 경우도 발생하기 때문이다. 이는 공판과정에서 특히 중요한 부분이면서 쟁점이라고 할 수 있다. 소송참여자이면서 당해 사건의 직접적인 당사자인 피해자가 유일한 목격자이면서 증인이고, 피해자의 진술 내지 진술조서가 유일한 증거이거나 그것이 주된 증거인 상황이 발생할 수 있으며, 이 경우 피해자가 진술 내지 진술조서의 원진술자로서 공판준비 또는 공판기일에 법정에서 진술할 수 없는 상황도 발생할 수 있기 때문이다. 그러나 아동의 진술 내지 진술조서에 대해 증거능력 및 증명력을 문제삼는 태도는 아동의 특성 및 이에 기반한 역량을 전혀 고려하지 않은 것이라고 본다. 또한 아동에 대한 성범죄 사건의 수사 및 공판절차는 형사소송법 및 아동․청소년에 대한 각종 특별법에 명확하게 규정되어 있음에도 불구하고 이러한 사정들을 고려하지 않고 법령을 해석 및 적용하는 것이라고 본다. 이에 이러한 태도는 타당하지 않으므로 재고(再考)할 필요가 있다.

Abstract

Die Sache des Sexualverbrechens kann der Beschädigte ohne Unterschied des Geschlechts und des Alters ausmachen, daß auch von solchen Verbrechen meist ausmacht, wendet sich am Kind, was das Sexualverbrechen sein kann。 Hieran, wie auch kein Erwachsene zum Kind solche Handlung sein könne, kann der emotionale Teil des Menschen auch ausüben。 Als das meist Problem der Sache des Sexualverbrechens sich am Kind wendet, und kann zugleich der Teil des Streitpunkts sein, was im Gericht sein kann。 Wie in dieser Abhandlung der behandelnde Objektspräzedenzfall ist, sind wegen des Ereignens vom Aussagenprotokoll des Kinds die Beweiseskompetenz sowie die Beweiskraft auch kein das Anerkennen。 Hierauf können im Gerichtsverhandlungsprozess besonders der wichtige Teil und zugleich der Streitpunkt sein。 Der Prozessesteilnehmer und zugleich der Beschädigte des unvermittelten Betreffenden der betreffenden Sache sind der einzige Augenzeuge und zugleich der Zeuge, und die Aussage des Beschädigten oder das Aussagenprotokoll können sich der einzige Beweis oder die Sachlage des hauptsächlichen Beweises ereignen, weil sich solche Fälle der Beschädigte vom ursprünglichen Aussager der Aussage oder des Aussagenprotokolls in der Gerichtsverhandlungsvorbereitung oder dem Gerichtstag zum Gerichtshof kein das Aussagen auch die Sachlage ereignen können。Aber die Einstellung die Beweiseskompetenz sowie die Beweiskraft in den Fragen haben von der Aussage oder dem Aussagenprotokolls stellengezogen, was die besondere Eigenschaft des Kinds sowie in dieser Basis die Fähigkeit genz nicht berücksichtigen。 Hierzu ist, obwohl die Ermittlung der Sache des Sexualverbrechens sowie das Gerichtsverfahren über das Kind in der Strafprozeßordnung sowie jedem Sondergesetz über das Kind und den Jugendliche bestimmt bestimmt haben, sehen solche Sachlagen kein Berücksichtigen die Gesetze und die Verordnungen das Auslegen sowie das Anwenden。 Hierauf brauchen solche Einstellung kein das Gültige nochmals zu überlegen。
