자동차의 운행과정에서 생성된 데이터에 대한 권리의 귀속; ALI-ELI 제원칙상의 공동생성데이터를 중심으로

이 논문에서는 커넥티드 카의 운행과정에서 생성된 데이터에 대한 권리의 내용 및 귀속에 대하여 유럽과 미국 법률협회의 공동작업으로 2021. 9. 최종초안이 승인된 ALI-ELI 제원칙을 중심으로 검토해 보았다. 그 검토 결과, 데이터 권리를 소유권의 관념보다는 다양한 채권적 권리(권능)들의 집합으로 파악하면서, 일정한 요건을 충족하는 경우에 개별적 권리(권능)인 접근권, 중지권, 정정요구권, 이익배분요구권 등을 행사할 수 있도록 한 ALI-ELI 제원칙의 접근방법을 우리나라에서도 수용할 만하다고 생각하였다. 그리하여 필자는 커넥티드 카의 운행과정에서 생성된 데이터에 대하여 기본적으로 정보주체인 운전자나 자동차 제조회사에게 데이터 권리가 우선적으로 귀속된다고 보았다. 그러나 자동차 구매시 체결된 데이터 권리 포기 약정이 유효하다고 볼 경우도 있고, 자동차 회사에게 데이터 권리가 귀속될 경우에 공익적인 이유 등으로 제3자에게 접근권이 인정되는 경우가 있을 수 있음을 살펴보았다. 특히 정보주체 이외의 자에게 접근권이 인정되는 경우에는 개인정보에 관한 운전자의 권리가 훼손되지 않도록 익명화 등의 조치를 취하여야 함도 살펴보았다. 이러한 데이터 귀속에 대한 논의는 매우 초보단계에 불과하다. 앞으로 위 논의를 전개함에 있어서 개인정보의 보호에 소홀하지 않으면서도 데이터 거래의 활성화를 기할 수 있는 길을 모색하여야 할 것으로 생각된다.
Abstract
In this paper, the contents and attribution of rights to data generated during the operation of connected cars were reviewed, focusing on the ALI-ELI Principles approved by the European and American Law Associations in September 2021. As a result of the review, we may consider adopting the approach of the ALI-ELI principle. Therefore, I considered that, for the data generated during the operation of the connected car, the rights belong to the driver who is the subject of information, or the automobile manufacturer which contributes a great deal for the generation of the data. However, it was also examined that if the data rights are waved in an agreement when purchasing a car is considered valid, the data rights including personal data could be attributed to the automobile manufacturer, and in some instances, a third party may have access rights for public interest reasons. In particular, if access rights are recognized by persons other than the subject of information, measures such as anonymization should be taken to prevent the driver's right to personal data from being damaged. My research may be only a rudimentary stage. In developing the above discussion in the future, I think that it is necessary to find a way to revitalize data transactions without neglecting to protect personal information.
