Abstract

All people are guaranteed their fundamental rights under the constitution law. Even individuals who have committed crimes are entitled to these constitutional rights without exception. Any restriction on such rights must appear only when necessary for national security, the maintenance of public order, or public welfare. Accordingly, the protection of fundamental rights must be equally ensured for everyone on anytime. In this context, prisoners must also be guaranteed those constitutional rights. Overcrowding in correctional facilities should infringe their rights. Correctional facilities has a for inmates’ moralization and reintegration into society. Therefore, during incarceration, moralizational and correctional programs must be conducted, along with vocational training for post-release employment and educational programs for continued learning. To achieve these functions, adequate management and not overcrowding within living quarters should be preserved. Constructing new buildings or expanding existing ones cannot be only solution to overcrowding. Instead, systematic and policy-based measures can be more effective. In particular, it is necessary to establish a legal standard for the minimum living space per inmate because of no current legislation. Legal codification of this standard is essential to protect the human rights of inmates. Furthermore, revisions to the Criminal Act may be needed to readjust the duration of imprisonment and confinement, as extending terms of incarceration inevitably increases overcrowding. The abolition of short-term imprisonment (less than six months) should also be considered, since short-term inmates often learn criminal behaviors from others or get risks of infection from contagious diseases such as COVID-19. In addition, offenders who are not afford to pay fines within the prescribed period are subject to confinement in a workhouse, which in practice functions similarly to imprisonment and contributes to over crowding. Therefore improvements in the system of confinement in a workhouse are also necessary. The current parole system is required such period only after 20 years for life imprisonment or after one-third of the sentence for limited-term imprisonment. However, only the warden of a correctional facilities authorized to submit a parole application, which raises concerns regarding fairness and equality, as inmates themselves are not granted the right to apply. In conclusion, Granting inmates the right to apply for parole when they meet the statutory requirements would help alleviate overcrowding in correctional institutions. Expanding physical facilities has limitations to resolve overcrowding. It is why a variety of policy measures are needed. This study aims to find effective and practical measures to secure the feasibility and ultimately reduce overcrowding in correctional facilities.
