고압송전선로건설 분쟁의 제도적 프레임 분석: 765㎸ 신고리-북경남 선로 기장군 구간 사례를 중심으로

본 연구는 제도적 프레임 분석틀을 활용하여 울산광역시 울주군에서 시작하여 부산광역시 기장군 정관면과 경남의 양산 그리고 밀양을 거쳐 창녕군의 북경남변전소에 이르는 90.5㎞의 765㎸ 고압 송전철탑 162기 건설과정에서 나타난 분쟁사례를 분석했다. 첫째, 고압송전철탑과 선로가 경과하는 지역주민들은 흉물스러운 철탑으로 인한 지가하락과 건강상의 위해에 대한 불안감 나아가 직접적인 토지보상의 부족으로 심각한 피해의식을 내재하고 있었다. 특히 기장군은 이미 우리나라 최초 원전인 고리원전이 들어서 있어 주민들은 늘 폭탄을 베고 자는 두려움에 휩싸여있으면서 수많은 송전선로가 거미줄처럼 지나는 지역이다. 더구나 2009년부터 입주를 시작한 정관신도시 주민들은 생태도시를 꿈꾸며 들어왔다가 90ｍ에 달하는 고압송전철탑이 들어서는 것을 보고 젊은 층을 중심으로 반대투쟁에 돌입하게 된다. 둘째, 기장군 지역주민들은 이러한 피해의식이 강하여 합의형성이 매우 어려운 내부 상황적 조건을 형성하고 있었다. 더구나 전자파의 안전성에 대한 상반된 해석과 보상의 불공정성에 대한 상반된 해석에서 출발한 상반된 프레임 집단이 형성된 가운데, 기장군수가 반대투쟁의 선봉에 서고 지역주민들은 물론 시민단체와 정치권까지 가세하면서 반대 프레임이 확장되어 정책추진주체인 지식경제부와 한국전력의 개발 프레임을 압도하였다. 셋째, 이러한 분쟁 해소를 위한 갈등조정위원회와 태스크포스 그리고 조건부 협상에 이르기까지 다양한 형태의 조정과 중재 역시 실효성을 확보하지 못하면서 결국 행정소송에 의한 합의강제로 압박을 받은 기장군수가 2012년 3월 9일 진입로와 작업장 부지 개발허가를 하고 한전은 소를 취하하면서 분쟁은 종결된다. 넷째, 제도적 프레임 분석 결과 정부에서 제안하는 다양한 수준의 게임의 규칙 중에서 경과지 선정규칙과 불공정한 보상규정이 일방적으로 실행되면서 고압송전탑을 둘러싼 분쟁을 해소하기보다는 오히려 분쟁을 격화시키는 기제로 작동하여 합의형성을 더욱 어렵게 만들고 있는 것으로 나타났다. 이러한 장기적인 분쟁을 사전에 예방하기 위해서는 제도개혁을 통한 합의형성을 기대할 수밖에 없는 것으로 평가되었다. 그것은 고압송전선로 경과지 선정 과정에서부터 이해관계자를 참여시키는 협력기획을 제도화하는 방안과 송전철탑부지와 선하지에 대한 보상규정을 합리적으로 개정하고 보상을 현실화할 수 있는 재원을 마련하는 방안이다. 나아가 본 연구에서는 프레임 분석 결과는 물론 조정과 중재 결과 그리고 판례들이 제도형성에 지속적으로 반영되는 메커니즘을 제안했다.
Abstract
The purpose of this paper is to analyse the construction controversies around 765㎸ Transmission Line around Gijang County through institutional frame approach. The findings are as follows. Firstly, the residents in Gijang County felt that they were in danger of being damaged by the nuclear power plant and cobweb-like transmission lines. So it was very difficult for them to reach an agreement in terms of internal-situational conditions based on the attributes of the community affecting the structure of the action arena. Secondly, the different interpretations on the safety and frame conflict between the two groups made policy disagreements develop into policy controversies. Thirdly, they failed in building the consensus through mediation with some kinds of dialogue arrangements, and finally the controversy was terminated by the litigation. Lastly, central government's DAD(Decide-Announce-Defense) approach and unfair compensation rules based on the different institutions aggravated the controversies and antagonism between the two frame groups. So I suggest that the revision of the unfair game rules about supporting and compensating the regulated and the introduction of the collaborative planning be needed for the consensus-building and acquisition of safe electricities.
