사회적 위험 내지 생활위험으로부터 벗어나 인간다운 생활을 향유하고자 하는 염원은 국적을 불문한다. 이 글은 사회보장에 관한 외국인의 헌법상 지위 및 사회보장의 기본이념을바탕으로, 외국인의 사회보장수급권에 관한 우리 법의 태도와 사회보장법 개별 분야의 주요내용을 개관한 후, 개괄적이나마 그와 관련된 문제를 살펴보고 개선방향을 모색한다. 우리 헌법과 사회보장의 기본이념에 비추어 볼 때, 근본적으로 국적제도나 주민등록제와같은 제도를 폐지하지 않는 한 외국인의 출입국 내지 거주에 대한 행정적 통제는 어느 정도불가피한 것이나, 기본적으로 외국인을 단순한 관리나 통제의 대상이 아니라 우리 사회 공동체의 구성원으로 바라보고 맞이하는 관점이 요청된다. 사회보장제도와 관련하여서는 외국인의 사회보장 문제가 외국인의 인권 보장뿐만 아니라 사회통합 측면에서도 중요한 과제임을 인식할 필요가 있다.
Abstract
The desire to enjoy a humane livelihood free from social danger or risk is irrespective of nationality. Based on the foreigners’ constitutional status and the basic idea of social security, this article outlines the attitude of the social security law on the right to social security for foreigners and the major contents of the individual areas of the law. It additionally examines the related issues and ways to improve them in general. Unless the nationality system or registration system itself is abolished, administrative control over the immigration and residence of foreigners is inevitable to some extent. However, in light of the Constitution and the basic principles of social security, first and foremost we should take an inclusive view that foreigners are members of our society rather than objects of control or management. In relation to the social security system, it is necessary to recognize that social security for foreigners is important not only for guaranteeing foreigners’ human rights but also for their social integration.
