Abstract
This study examines the erosion of institutional integrity in the international response to North Korean human rights violations, with a particular focus on the dismantling of the UN Panel of Experts on DPRK sanctions following Russia’s April 2024 veto. The case illustrates how great-power politics can paralyze legal mechanisms and undermine the normative authority of the global governance system. Contrary to prevailing views that frame North Korean human rights solely as a normative issue, this paper underscores its security dimension-intertwined with nuclear proliferation, illicit financial networks, cross-border surveillance, and forced labor. Tracing the international agenda-setting process since the 1990s, the study critically evaluates the limitations of existing UN mechanisms-treaty bodies, special procedures, and the Universal Periodic Review-while comparatively analyzing alternative mechanisms such as the Syria IIIM, Myanmar IIMM, and the Multinational Sanctions Monitoring Team (MSMT). Despite their emergence as potential stopgaps, these mechanisms face structural weaknesses in legal authority, sustainability, and political legitimacy. The paper identifies five key conditions for strengthening institutional resilience: i) systematic evidence collection under non-permissive conditions; ii) enhanced collaboration with civil society and defector networks; iii) functional integration with extra-UN mechanisms; iv) expansion of transnational information-sharing networks; and v) the establishment of independent investigative bodies insulated from political manipulation. Ultimately, North Korea’s human rights crisis serves as a litmus test for the adaptability of international norms and institutions. The study argues that South Korea, by leveraging its strategic position and democratic legitimacy, can play a pivotal role in shaping post-crisis institutional architecture and advancing norm-based multilateralism.
