프로스포츠선수계약에 대한 법적 접근 - 경제법적 규제와 노동법적 보호의 관계 -

프로스포츠선수계약관계에 대한 경제법적 규제와 노동법적 보호는 경제법과 노동법의 적용영역과 기본적인 접근방향의 차이로 인하여 일견 모순되는 것처럼 보인다. 그러나 프로스포츠의 본고장인 미국에서 프로스포츠에 대한 경제법적 규제와 선수조합의 활동에 의한 단체협약의 체결의 상호작용의 역사를 살펴보면, 선수조합이 구단측에 대하여 대등한 교섭력을 갖추지 못한 단계에서는, 선수들에게 반트러스트 소송이라는 무기를 제공하여 선수들의 권리를 보호함과 아울러 구단측과 선수들에게 성실한 교섭을 통한 단체협약 체결의 필요성을 절감하게 하였으며, 나아가 선수들의 단체와 구단측이 단체교섭을 하는 데에 선수시장과 선수활동의 제한에 관한 합리적이고 타당한 기준을 제공하여 왔음을 알 수 있다. 물론 우리나라에서 프로스포츠선수계약관계에 관하여 그 실질적인 법형식에 부합하는 가장 타당한 법적 접근은 프로스포츠 선수가 자율적인 노동조합을 결성하여 사용자인 구단측과 대등한 교섭력을 갖고 단체교섭을 하는 것이다. 그러나 아직 선수들의 진정한 교섭단위로서의 단결체가 형성되지 못한 현 단계에서는, 그리고 관련 당사자나 프로스포츠 소비자들의 시각에서 노동조합에 대한 충분한 공감대가 형성되지 못한 상태에서는, 경제법적 규제의 적극적인 활용이 가장 가능하고 유용한 수단이다. 프로스포츠선수의 근로자성의 인정 여부와 스포츠규약에 대한 경제법적 규제가 반드시 서로 모순된다고 볼 것은 아니다. 오히려 경제법적 규제가 합리성의 원칙에 따라 적정하게 이루어질 때, 선수들과 구단측 사이에 단체교섭이 촉진되며, 당사자 사이에 우리나라의 프로스포츠의 현실에 부합하는 합리적인 합의를 기대할 수 있게 될 것이다.
Abstract
It may seem there is conflict between the regulations by anti-trust law and the protection under labor law on the professional sports players contracts with owners of professional sports teams. However, american history of interaction between the regulations by anti-trust laws and conclusion of collective agreements on professional sports, offers the key to understand that in the stage when the bargaining power of the players association was not on an equal status with teams, players were given a weapon of anti-trust action against the league to protect the rights of players so that the league may feel a strong necessity for collective agreement through sincere negotiation in good faith. It should also be added that reasonable and appropriate standards of the players market and restriction on the activities of players were provided for the process of collective bargaining between the league and the players association. The most proper legal access in Korea is to proceed to a collective bargaining procedure after formation of self-regulatory labor union of players on an equal status in power with teams in terms of contract relationships of professional sports players. However, under current stage, where real and substantial organization of players as an unit for collective bargaining has not yet been formed, and where social consensus on an labor union has not been made from the view points of interested parties and professional sports consumers, active application of regulations by anti-trust laws is the most possible and useful measure. It is not always the case that whether to recognize the character of professional sports players as laborers or not and regulations by anti-trust laws on the sports contracts are contradictory each other. Rather, when regulations by the anti-trust laws are enacted properly in accordance with the rule of reason, collective bargaining process between players and teams will be promoted and in addition, reasonable conclusion of agreement between the parties based on the reality of professional sports of Korea will be expected.
