공영방송과 민영방송의 이중적 방송체제하에서 그 산업적·매체적인 경쟁이 치열해져가고 있는 현상은 비단 국내만이 아니라 국제적인 현상이다. 미국과의 자유무역협정 협상에서 전개될 방송·통신시장의 개방의 문제는 이제 공영방송과 민영방송의 국내적인 경쟁관계만이 아니라 국제적 경쟁관계를 발생시키고 있고 현실적으로는 방송시장의 개방화로 나타날 것이다. 이미 영화산업의 경우 기존의 국내영화 상영일수에 대한 쿼터제를 대폭 삭감해 국내 영화산업의 위축가능성이 예견되고 있어 방송시장도 과거의 안주상태에 머물러 있게 하지 않는다. 방송시장의 개방화시대에 맞아 중요한 문제점 중의 하나가 공영방송의 재정원으로 사용되고 있는 방송수신료의 지속적인 존속과 부과에 대한 정당성의 문제다. 신자유무역주의는 산업간의 경쟁관계를 왜곡하거나 방해할 수 있는 장벽의 제거, 즉 특정산업에 대한 관세에 의한 국내산업보호책의 제거만이 아니라 비관세장벽인 쿼터제, 국가보조금제도 자체의 철폐를 주장하기도 하는데 현행 방송수신료는 이런 차원에서 방송시장의 개방화에 대한 뜨거운 감자로 등장할 가능성이 크다. 그러나 현재 이에 대한 논의는 본격적으로 이루어지고 있지 않다. 이에 본 논문에서는 이런 우리의 현실적인 문제의 해결책을 찾는 과정으로 이미 유럽공동체라는 거대한 정치·경제 공동체속에서 형성된 공영방송의 운영에 필요한 방송수신료의 정당성이라는 문제를 살펴보고자 한다. 방송수신료의 법적인 의미를 유럽공동체조약 및 관련 의정서와 각국, 특히 독일의 방송관련법과 판례를 중심으로 살펴보면서 방송수신료는 단순히 산업간의 경쟁을 왜곡하거나 방해하는 단순의미의 보조금이 아니라 공영방송의 기능적인 과업수행을 위한 국가외적인 특별한 부담금의 성격을 가지고, 또한 방송은 한 국가공동체의 존속 및 발전의 바탕이 되는 문화형성에 기여를 하는 요소로서의 성격을 가진다는 측면에서 방송수신료는 우리 현실에서 신자유무역주의에 대응하는 공영방송의 운영재원으로서의 존속과 부과에 대한 정당성을 가진다는 주장을 결론 및 논의에서 제시하고자 한다.
Abstract
This Essay explores the fairness of the broadcasting fee in the public broadcasting system. Nowadays the competition between public and private broadcasting system has been increased both industrial and cultural area. But this tendency is not only in domestic problem, but also an international problem. With the enforcement of free trade tendency the public broadcasting system confronted a serious problems. The free trade tendency does not allow any state aid in the area of industry including broadcasting and communications, which interfere the invisible hands of Adam Smith. There has been not published so many essays yet, which contains the legal solutions in respect to the problems of the fairness of broadcasting fee in the public broadcasting system. In contrast to our situation the european community has been so much discussed this legal problem and sentenced some of opinion. This foreign discussions and official opinions of the international and domestic court in europe are very helpful to our situation of broadcasting area. So I want to introduce the legal problems of the broadcasting fee with the §87 EGV(Europa ische Gemeinschaft Vertrag: European Community Treaty) in Europe at first and can offer the adequate legal preparation in respect the fairness of broadcasting fee in the time of free trade tendency.
