프로그램 포맷의 법적 위상과 보호 방안에 관한 연구 : 분쟁 사례 분석 및 법전문가 심층면접을 중심으로

최근 오락 포맷 프로그램의 유통과 편성이 증가하면서 불법적 표절이 증가하고 있으며, 이는 자연스럽게 오락 포맷 프로그램에 대한 법적 관심을 환기하고 있다. 본 연구는 이에 따라 국제 포맷 분쟁 사례 분석을 통해 프로그램 포맷의 법적 지위를 해명하고, 포맷이 주로 거래되고 있는 주요국 법전문가와의 심층인터뷰를 통해 포맷의 실증적 지위 및 포맷 저작권 확립을 위한 대안을 모색해 보고자 하였다. 소송 사례 분석결과, 분쟁 시 저작권 침해가 인정된 사례가 드물며, 최근에는 전체적 인상 테스트를 통해 소수 포맷이 저작물로 인정되고 있음을 확인하였다. 이러한 사실은 포맷의 보호를 저작권법에만 위임하는 것은 위험소지가 다분함을 시사한다. 그러나 법전문가와의 심층면접 결과, 비밀유지의무의 위반, 사칭통용 금지, 상표권 등록, 의장권 등록 등을 통해 포맷의 권리가 실질적으로 인정되고 있음을 발견하였다. 또한 비법적 장치 역시 포맷 권리 강화에 도움이 됨을 알 수 있었다. 이는 국내 포맷의 저작권 보호를 위해 보다 적극적인 장치가 마련되어야함을 시사한다.
Abstract
With increasing international format production and distribution, illegal copyings of formats are also in rise. Facing with this issue, this study investigates legal status of program format by analyzing international format dispute cases and in-depth interviews with legal professionals in major oversea format markets. According to the analysis, a few formats has been recognized as copyrightable materials under the ‘overall impression test’. However, in-depth interviews with law professionals have indicated that legal protections besides copyright are available: the laws of confidentiality, passing off, trademark, and design. Furthermore current study suggests that the use of non-legal tools can be effective in protecting formats from illegal copying. It is thus proposed that more active measures should be applied for the protection of domestic format in its infancy.
