방송시장이 커지면서 국제적으로 포맷 거래와 포맷 표절 분쟁이 이슈가 되고 있다. 포맷의 보호와 관련하여서는 저작권법적 보호가 가능한가 하는 것이 논의의 초점이다. 분쟁 사례를 분석하면 포맷의 저작물성을 아예 부인하는 경우가 많으나 과거 캘리포니아 주에서는 라디오 포맷을 당연히 저작물로 보호하기도 하였다. 여전히 다수 분쟁은 포맷의 저작물성을 부인하고 있다고 보이나, 포맷의 저작물성을 인정하되 다만 구체적인 분쟁 상황을 보건데 아이디어의 침해에 그친다는 결론이 종종 발견된다. 포맷의 시장이 커지고 현실적으로 보호의 필요성이 증대하는 만큼 일응 포맷의 저작물성은 전제하는 것이 바람직하다고 판단한다. 저작권제도는 다분히 정책의 산물이므로 포맷의 저작물성도 정책적으로 인정하지 못할 바 아니다. 그렇다면 문제는 어떠한 경우에 표현의 침해를 인정할 것인가에 있다. 결국은 Greeting Cards 사건의 "total concept and feel"과 Feist 사건 등의 "originality by combination"에 대하여 저작권 보호를 하는 입장을 따르게 될 것이다. 다만, 이러한 방식의 저작권 보호는 이른바 약한 저작권(thin copyright)에 대한 저작권 보호이므로 구체적인 적용에서는 주의를 요하는 것이 사실이다. 저작권법에 의한 보호 이외에도 국내외에서 부정경쟁방지법에 의한 보호도 논의되고 있다. 서울고등법원은 <짝> 사건에서 저작권법적 보호와 부정경쟁방지법에 의한 보호를 모두 부정하였는데, 분쟁 상황을 ‘조합에 의한 창작성’이 인정된 ‘표현’의 침해로 보고 공정이용(저작권법 제35조의 3)에 의하여 책임을 면하게 하는 방식이 시장의 변화에 순응하는 결론이 아니었나 하는 생각이다.
Abstract
As the international broadcasting market grows, format protection has become an issue. Regarding format protection, the main question is whether copyright protection is possible. Some cases denied copyrightability of the format at the outset, pre-1947 California statute protected format as property per se. Still majority cases do not affirm copyright infringement in format piracy surroundings, but the incidents are increasing where Courts finds copyright was infringed. The reasoning is usually based on "total concept and feel" or "original selection or arrangement". But to apply these reasoning we should be very careful, because it is protection of so called "thin copyright". Besides copyright, unfair competition is often referred to format protection. Regarding <JJak> dispute between SBS and CJ E&M of 2014. Seoul High Court rejected both the copyright infringement claim and unfair competition claim(passing-off). I think it would have been better for Seoul High Court to have decided 'expression' was infringed, however CJ E&M was exempted because the appropriation was 'fair use'.
