Abstract
The establishment of Europol was agreed in the 1992 Maastricht Treaty, officially known as the Treaty on European Union(TEU) that came into effect in November 1993. In 1998 the Europol Convention was ratified by all the member states. Europol commenced its full activities on July 1, 1999. By 2008, Europol covers all 27 member states of the EU. Europol acts as the European Law Enforcement Organization which aims at improving the effectiveness and cooperation of the competent authorities in the member states in preventing and combating terrorism, unlawful drug trafficking and other serious forms of international organised crime. In order to fight them effectively, Europol cooperates with a number of third countries and organizations. Europol has no executive powers. It functions as a support service for the law enforcement agencies of the EU member states. This means that Europol officials are not entitled to conduct investigations in the member states or to arrest suspects. In providing support, Europol with its tools - information exchange, intelligence analysis, expertise and training - can contribute to the executive measures carried out by the relevant national authorities. The Head of Europol is the Director who is appointed by the Council acting unanimously, after obtaining the opinion of the Europol Management Board which is composed of one representative of each Member State. Europol is politically accountable to the Justice and Home Affairs Council via the Europol Management Board. The Council also handles Europol's budget financed from fund-raising of member states. Generally speaking, Europol is an organization with intergovernmental character rather than with supranational one. However, in view of the following two aspects Europol will reflect more supranational character in future. First, it has been decided that Europol will be converted to a full EU body in 2010. Second, one of prominent changes introduced with the Treaty of Lisbon is the elimination of the pillar system.
