지식재산권 이론을 통해 본 한중일 FTA 협상 시의 시사점

본 논문에서는 한중일 FTA 협상 추진 시 삼국 간 지식재산권 보호 관련 이슈에 관하여 고찰하였다. 또한 지식재산권 협상 시 한국 측 입장을 고려한 대응 전략에 관하여 분석하였다. 이는 국가차원의 지식재산권 보호수준 강화와 경제 발전에 관한 종합적인 고려를 시도함을 의미한다. 기존의 선행연구가 제시한 ‘경제발전 및 지식재산권 보호수준의 변화에 관한 U자형 이론’과 지식재산권 보호수준의 강화가 기술혁신 및 연구개발 투자에 미치는 영향을 분석한 역U자형 관계 모형을 토대로 국가의 산업 및 통상 정책 개입 시점을 찾아 전략적 접근을 수행해야 함을 강조하였다. 본 연구가 주장하는 바는 다음과 같다. 즉 지식재산권 보호 수준의 지속적 상승, 기술 혁신 및 연구 개발 투자의 지속적 하락 및 경제 성장 둔화가 나타나는 시점(t2)에 이르면, 정부는 지식재산권의 사회적 규범 상승을 사회적 이익으로 환원하기 위한 산업정책 및 통상정책을 제시하게 된다는 것이다. 제시할 수 있는 정부정책으로 본 논문에서는 FTA 체결 시 특혜협정 중 지식재산권 분야 규범의 강화를 통해 자국과 비교하여 상대적으로 관련 사회규범 수준이 낮은 국가를 변화시켜야 함을 검증하였다. 더불어 국가의 산업 및 통상 정책 개입 시점에서 정부가 제시할 수 있는 주요 산업 및 통상 정책으로 다음 두 가지를 부가할 수 있다. 첫째, 지식재산권 보호 수준 강화로 해외직접투자를 유인함과 둘째, 국제협약 등 다자간 협정을 주도하여 지식재산권의 세계적 수준을 향상시키는 것이다. 필자는 향후 지식재산권 보호 수준 강화로 해외직접투자를 유인에 관한 연구를 계속 과제로 추진하고자 한다. 기존의 사례를 통한 경험적 연구 토대가 마련된다면 향후 한중일 FTA의 지식재산권 협상 및 한국의 정책 방향 제안에 주요한 선행 자료가 될 것으로 기대한다. 삼국 간 FTA 개시 가능성이 언급되는 이 시기는 한중일 지역 특수성과 지역협력의 보편성을 충분히 고려하여 한중일 FTA 협정 이후 역내 시장의 변화에 관한 성숙한 논의가 필요한 때이다. 따라서 본 연구는 한중일 삼국 간 지역 경제협력 추진 시의 통상 협상 중 공동규범의 초기 단계 형성 및 향후 발전 과정에 관하여 분석하고자 하였다. 한중일 각각의 국가가 다수의 FTA를 체결해 온 상황에서 한중일 FTA를 체결함은 초기 단계에서부터 일정한 규제 표준화 접근이 반드시 수반되어야 할 사안임을 지적하는 바이다. 따라서 지식재산권 영역의 높은 수준의 표준 규정을 마련하기 위한 논의가 전개되어야 할 것이다.
Abstract
This paper aimed at analysing IPR(Industrial Property Rights) related issues in the Korea-China-Japan FTA. Also, considering the importance of IPR in the Korea-China-Japan FTA, this study examines the IPR protection system for Korea's position. This paper examines from various angles the complex relationships between economic development and IPR protection at the national level, and between IPR and technological innovation. In order to analyze the Korea's FTA strategies for IPR protection, this paper introduces a graph of correlation between economic development and IPR protection, putting U-shaped theory and an inverted-U-shaped relationship model. According to the results, as a country's economic development level arrives at t2, strengthening of foreign IPRs protection, decreasing of R&D investments and, a slowdown in economic growth, the government should suggest a certain industrial policy or trade policy regarding social high criterion has been superseded by social benefits. If a negotiation for the Korea-China-Japan FTA begins, in this situation it is not difficult to see that IPR related issues will be critical. Considering the importances of IPR in the Korea-China-Japan FTA negotiation, this research examines the IPR protection system for three countries, and reviews the expected issues.
