평화체제의 구축과 남북한 협력: 협상론과 제도적 구속성의 관점에서

초록

본 연구는 판문점선언과 평양선언을 분석하고, 6·25전쟁 종전선언과 현재의 휴전체제 전환과 관련된 유의점들을 규명하였다. 비대칭 협상의 특성을 지닌 양대 선언에 북한은 임의적 해석을 위해 뿌리 깊은 “원칙 합의” 전술을 사용하였다. 한국의 일방적 “교류·협력”은, 북한정부의 임금갈취 시스템에 대한 시정이 없기 때문에, 북한주민들에게 1/20에 그치는 불리한 경제적 파급효과를 낼 것이 확실시 된다. “9월 평양공동선언”은 이산가족 문제에서 제도적 후퇴를 보이고 있다. 본 연구는 선언들을 살라미(salami) 전술과 양보의 가역성(可逆性) 면에서도 검토하였다. 휴전체제의 전환과 관련하여 휴전(정전)협정의 명칭, 대체의 당위성, 한국의 당사자 및 전환의 형식 문제에 대해 검토한 뒤에, 제도적 구속력의 확립을 제안하였다. 한반도 평화체제를 완성하기 위해서는 김대중 정부 이후의 모든 남북 합의들을 1991년 남북기본합의서의 기초 위에 결합시켜야 된다. 이 제도적 장치의 구속성에 대한 중국과 미국의 보증이 전쟁 억제력을 강화시킬 수 있을 것이다. 그러나 북한의 정치·사회적 변화 없이 평화협정이라는 서면(書面)협정으로의 단순 대체에 기초한 평화체제는 형식논리만 갖춘 허상에 지나지 않을 것이다.

Abstract

This research examines the two joint declarations from the inter-Korean summit talks at Panmunjom and in Pyongyang, and highlights attention points related to “the declaration to end the Korean War” and transformation of the current armistice regime. In both declarations, which have features of asymmetric negotiation, North Korea applies its deep-rooted tactic of “agreement in principle” for arbitrary interpretations. Meanwhile, the South Korean one-sided “exchanges and cooperations” will surely have a detrimental economic ripple effect on the North Korean people at 1/20 due to the lack of any adjustment for the current governmental wage extortion system in North Korea. Plus, the “Pyongyang Joint Declaration of September 2018” exhibits a retrogression of institutionalization on the question of dispersed families. This research also examines the declarations from the perspective of salami tactics and concession reversibility. Moreover, as regards transforming the current armistice regime, the name of the agreement (armistice/truce), appropriateness of replacement, question of South Korea as a legal party to the agreement, and mode of transformation are all reexamined, while also proposing ensuring institutional binding force. To accomplish a peace regime on the Korean Peninsula, all the inter-Korean accords since the Kim Dae-jung administration need to be combined based on the Inter-Korean Basic Agreement in 1991. The deterrence of war can also be strengthened by Sino-American assurances of the binding force of the institutional apparatus. However, without North Korea’s socio-political change, a peace regime based on simply replacing the paper agreement, i.e. Peace Agreement, is just an illusion fortified with formal logic.
