헌법상 경제질서와 사회적 시장경제론의 재고

초록

경제질서에 관한 기존의 논의는 자본주의시장경제를 전제하고, 이에 대한 일정한수정의 범위와 그 원리를 중심으로 전개되고 있다. 그 과정에서 사회적 시장경제론은논의의 중심에 위치한다. 그러나 우리 경제의 설명 방식으로서 사회적 시장경제론의한계를 지적하고 대안을 제시하는 견해도 유력하다. 사회적 시장경제론에 대하여 어떠한 입장을 취하든지 간에, 논의의 출발점으로서 독일에서 형성된 사회적 시장경제론자체에 대한 내용적 이해를 충실히 하는 것은 여전히 중요하며, 이는 사회적 시장경제론에 대한 비판적 관점을 수용하고, 나아가 사회적 시장경제의 대안 또는 재구성을위한 논의의 기초가 될 것이다. 독일의 사회적 시장경제는 전후 경제질서를 새롭게형성하는 과정에서 시장 원리와 사회 원리의 결합으로 나타났다. 이는 두 영역의 고유한 의의를 인정하고, 경제질서의 구성 원리로서 어느 하나를 포기할 수 없다는 사고에 기초하였다. 시장이 유효하게 기능할 경우에 달성할 수 있는 성과에 대한 신뢰와그 이면에 있는 경제주체의 자율성에 대한 존중이 시장 원리를 수용하는 근거가 되었다면, 시장의 한계에 대한 인식과 사회국가적 요구를 실현하기 위한 방식에 대한고려는 사회적 영역의 존재를 승인하는 결과를 낳았다. 이러한 이론을 우리 경제에적용할 때 이론과 현실 사이의 간격이 드러나며, 이에 대한 비판은 유효할 것이다. 그러나 시장과 사회를 영역적으로 분리하고 또한 전체 경제질서로 통합하는 이론구성은 여전히 타당성을 갖는다. 이러한 이론 구성이 단순한 원리 간의 기능적 결합또는 보완적인 결합으로 시도된 것이 아니라, 결합의 두 축인 시장 원리와 사회 원리모두 헌법상 기본권으로부터 도출되며, 결합으로부터 각각의 이념적 가치가 훼손되지않고 실현될 수 있다는 점, 그리고 헌법 제119조 등의 경제조항은 두 원리의 결합을예정하고 있다는 점은 이론적 타당성을 뒷받침한다. 이론과 현실의 괴리를 극복하는문제도, 이론적 타당성이 주어졌던 바로 그 지점에서 출발할 필요가 있다. 이러한점에서 사회적 시장경제는 시장 원리와 사회 원리의 헌법 이념적 근거를 확인하고,각각의 실현 방법과 가능성의 비교를 통하여 최선의 방식을 찾는 과정을 의미하며,이를 통하여 경제질서의 원리로서 구체적인 의의를 갖게 될 것이다.

Abstract

The Social Market Economy means the economic order or economic order theory developed after World War II in Germany. The social market economy stresses the importance of market because of the efficiency of distribution of the resources and production of goods, and the ideology related the assurance of the human worth and dignity. So in the economic order that approves the importance of market, the only state role in the economy shall be limited to protect the competitive environment from monopolistic or oligopolistic tendencies. On the other hand the social market economy is indelibly associated with the demands of social states, could not be realized by the market systems. That is to say the social market economy has been formed and developed as economy that would not only help the wealthy but also care for the workers and others who might not prove able to cope with the strenuous competitive demands of a market economy. There are some distinctive differences between the social market economy in Germany and the economic operating systems in Korea. But the social market economy could not be deprived of the theoretical validity from the differences. The equivalent combination of the market principles and the demands of social state is still important in korean economy and has the bases in constitutional law.
