선박안전법상 선박용물건 형식승인제도의 한계에 관한 단상

일반적으로 선박안전법상 선박용물건의 형식승인제도는 지정된 선박용물건이 적용되는 모든 기술기준상 품질 및안전요건을 준수하도록 함으로써 대량생산에 준비토록하고 국제시장에서 적합성 관련 인정을 받도록 하는데 있다. 하지만 유럽이나 미국과 같은 외국과 달리 우리는 여전히 정부주도형 형식적인 검사체계로서 주로 시험기관의 시험 성적서에 의존하고 있어서, 보다 민간전문검사단체에 의해 잘 수행될 수도 있는 의미 있는 도면검토절차가 요구되지 않고 있다. 이는 국내 제품이 외국에서 신뢰도와 성능표준의 면에서 국제적으로 인정받는 것을 어렵게 했던 것으로 보인다. 이논문에서는 선박안전법상 선박용물건의 형식승인에 관한 몇 가지 현재의 규범체계의 한계점을 지적하고 그에 상응하는입법정책을 제안하고자 한다.
Abstract
Generally, the statutory type approval program under the Ship Safety Act is to ensure that the designated ship equipment of the Act comply with the quality requirements as well as safety ones under any applicable technical standards to make them ready to be mass-produced forward and recognized in respect of conformity in the global market. However, unlike the foreign countries such as the EU and the U.S., we still maintain the government-led perfunctory inspection system mainly dependant upon a testing certificate issued by certain approved laboratories, not requiring any meaningful design approval procedures which may be better implemented by more specialized private inspection bodies. Apparently, this has hampered our domestic products from being globally acknowledged in terms of reliability and performance standards in the foreign soils. This paper aims to point out a few limitations of the current normative framework regarding the type approval of ship equipment under the Ship Safety Act and to suggest corresponding legislative policies.
