Abstract

This paper reviews 40 years debates on Affirmative Action in the United States of America, focusing on the subjects of necessity, effectiveness, legitimacy, and dysfunction. The effectiveness of the Affirmative Action has been revealed in the history. The debates on the other three subjects reflect the perspectives on the following two aspects. One of the most important differences between advocates and opponents of the Affirmative Action comes from the belief on the meritocratic social system. The opponents believe that the society is dominated by the meritocracy and that discrimination appears as a social problem just in case that the meritocracy malfunctions. On the other hand, the advocates raise questions if the so-called “meritocracy” is fair in the real world. The other difference between advocates and opponents of the Affirmative Action is based on the perspectives on the relationship between the past and the current discriminations. Opponents believe that the ordinary discrimination acts works fine to prevent further discrimination against women and minorities. In this perspective, the Affirmative Action is not legitimate because white males who are innocent of acts having caused harm nonetheless being forced to provide restitution for such acts. On the other hand, advocates of the Affirmative Action argue that preferential treatment be justified in terms of distributive justice. In this perspective, the ordinary discrimination acts are not enough and 'leveling the ground' should be necessary to solve the discrimination problem because the current discrimination is closely related with the past one.
