공익사업“생활대책”은 분당․일산 등 신도시건설과 관련된 사업지구내의 주민에 대한 은혜적 배려로 특별지원대책의 일환으로 1991년 한국토지공사가 자체규정을 만들어 수립․시행한 것이다. 생활대책은 이주대책과는 별도로 원활한 사업추진을 위하여 택지개발사업 등에서 영업보상대상자 등에게 일정한 규모의 상업용지 또는 분양상가를 우선 공급하는 사업시행자의 자체 운영제도이다. 생활대책은 「공익사업을 위한 토지 등의 취득 및 보상에 관한 법률」 제78조의 규정에 의하여 공익사업에 주거용 건축물이 편입되어 생활근거를 상실하게 되는 이주대책대상자에게 택지나 주택을 공급하는 이주대책에 대응하는 용어로 사용되고 있다. 현재 생활대책제도는 사업시행자 내부규정을 통해 제한적으로 운영되고 있다. 이러한 이유로 평석 대상판결인 은평뉴타운 등 대규모의 개발행위가 이루어지는 경우 상가분양권공급거부처분, 상업용지특별공급대상자부적격통보 등 이른바 생활대책에 관한 소송이 빈번하게 발생하고 있다. 이 글은 공익사업 생활대책의 의미와 정당보상원리를 통해 대상판결을 비판적으로 고찰하였으며, 주요쟁점은 생활보상의 성격, 생활대책의 정책적 의미, 소송형태, 생활대책에 관한 사업시행자의 재량권 행사 등이다. 평석 대상판결은 생활대책 상가용지공급대상자의 법적지위를 인정하여 재산권보장을 강화했다는 측면에서 그 의의가 있다. 다만 공익사업 생활대책이 비현실적인 영업보상으로 인한 민원을 해결하기 위한 임시방편으로부터 출발한 점을 개선하는 데에는 한계가 있다고 생각된다. 생활대책용지의 공급과 같이 공익사업 시행 이전과 같은 경제수준을 유지할 수 있도록 하는 내용의 보상은 정당보상원리에 따라 영업보상영역에서 해결해야 할 것이다. 따라서 토지보상법상의 영업보상을 현실화거나 보상항목을 확대하는 등의 입법론적 해결이 바람직한 접근일 것이다.
Abstract
“Survival measures" in public service were established by the Korea Land Corporation in 1991, which executed them its own regulations as part of special support measures for residents of areas hit by the New City construction, such as Bundang and Ilsan. Aside from the relocation measures, “Survival measures" are exclusive system of project operators that provide commercial lots or buildings of certain scales to business compensation recipients first for smooth execution of, for example, housing land development project. “Survival measures" are comparable to relocation measures that offer housing land or housing units to people who are about to lose their residents due to their consolidation into public service projects, in accordance with the article 78 of「Land Acquisition and Compensation Act. Currently, survival measures are being limitedly implemented through internal regulations of project operators. That is why frequent lawsuits occurred when large-scale development activities took place such as the Eunpyung New Town case. This text critically examines the trial verdict by explaining the meaning of public service survival measures and adequate compensation principles with focus on the nature of compensation, political meaning of survival measures, types of lawsuits, and discretion of project operators as to survival measures. The Eunpyung New Town case verdict is significant in that it reinforced the property rights by recognizing the legal status of recipients of survival measures for commercial land support. However, the measures are deemed to be limited in curing issues associated with demands for unrealistic compensation . Financial compensation for maintaining the economic status prior to execution of public service projects, such as offering residential lands, must be dealt with in accordance with fair business compensation principles. Therefore, legislative resolutions such as materializing business compensation or expanding the compensation scope will be desirable.
