외국보험회사의 해외 업무위탁에 관한 연구- 영국, 미국, 일본을 중심으로

영국, 미국, 일본 등 해외 주요국에서는 보험회사의 본질적인 업무를 제3자에게 자유롭게 위탁하고 있다. 즉 해외 선진국들은 오래전부터 보험계약 인수, 보험사고, 민원처리 등 다양한 업무를 제3의 보험전문기관에 위탁하고 있다. 이와 같이 해외 글로벌 보험회사들은 제3자와 업무위탁계약을 체결하고 주요 권한을 위임함으로써 해외 보험시장에서 성공적으로 보험영업을 해오고 있다. 그 배경에는 보험회사의 업무위탁에 대해서 자유롭게 지원해 주는 법률과 가이드라인 등이 존재한다. 그러나 우리나라의 경우 보험회사의 본질적 업무에 대해서 위탁을 금지하고 있다. 이는 우리나라 보험회사들이 해외에 진출할 때 큰 걸림돌이 되고 있다. 따라서 국내 보험회사들의 해외진출을 확대하고, 해외에서 성공적인 정착을 지원하기 위해서는 우선적으로 현행 업무위탁규정을 개정할 필요가 있다. 본 논문은 이러한 내용들을 다루고 있다.
Abstract
In major countries the United Kingdom, the United States of America and Japan, the essential work of insurance companies is freely entrusted to third parties. In other words, overseas advanced countries have been entrusting various tasks such as insurance underwriting, insurance accidents and complaints handling to a third insurance agency for a long time. As such, overseas global insurance companies have successfully concluded insurance business in the overseas insurance market by contracting with third parties and delegating their major authority. In the background, there are laws and guidelines that provide free support for the entrustment of insurance companies. However, Korea is prohibiting entrustment of the essential business of insurance companies. This is a big obstacle when Korean insurance companies enter overseas markets. Therefore, in order to expand domestic insurance companies' overseas penetration and to support successful settlement abroad, it is necessary to improve the Regulation on the Entrustment of Business of Financial Institutions first. This paper addresses these issues.
