미국ㆍ일본에 있어 생명보험전매 추세 및 규제현황

생명보험전매 문제에 대해 우리나라에서는 지금까지 본격적인 논의가 이루어지지 않고 있는 상황이다. 이에 반해 일본에서는 생명보험전매 문제가 2005년 11월 생명보험계약의 보험금수익자 명의변경을 둘러싼 판례를 계기로 실질적으로 처음으로 주목을 받게 되었다. 미국의 경우 생명보험전매가 일반적으로 이루어지고, 전미보험감독관협의회(National Association of Insurance Commissioners, NAIC)에 의해 생명보험전매 모델법(Viatical Settlements Model Act) 및 모델규칙(Viatical Settlements Model Regulation)이 승인되었다. 따라서 본 연구에서는 생명보험전매 행위를 사업의 한 형태로 인정하고 있는 미국에서 전매와 관련한 규칙 및 그 도입 배경 등을 검토하였다. 또한 판례를 통해 생명보험전매 문제가 이슈화되었던 일본의 경우 법제화와 관련하여 어떤 변화가 일어 나고 있는가에 대해 검토하였다. 이를 통해 향후 보험전매제도의 국내 도입시 우리에게 주는 시사점에 대해 검토하였다.
Abstract
Settlement sales have not been seriously discussed in Korea. Comparatively in Japan, the Case associated with "the Transfer of the Beneficiary" first substantially awakened the attention to the Settlement sales. In US the Settlement sales are generally accepted, and NAIC (National Association of Insurance Commissioners) already approved Viatical Settlements Model Act and Viatical Settlements Model Regulation. In this respect, this paper reviewed the regulation associated with the Settlement sales of US, which already approved the Settlement sales as a new business model, as well as the background of the regulation. In addition this paper also reviewed not only the case of Japan, where the Settlement sales involved with the Case has been an issue, with the focus on the changes evolved in the legalization, but also the implication and the regulatory considerations to Korea.
