평생교육법상 교육감과 지방자치단체의 권한 연구

평생교육 진흥을 목적으로 제정되어 시행되고 있는 평생교육법이 교육감과 지방자치단체장의 권한 측면에서 어떤 문제점이 있는지를 살펴보고 그 개정과제를 제시하고자하였다. 첫째로 시‧도별 평생교육진흥시행계획을 수립함에 있어 시장‧도지사가 교육감과 협의하도록 되어 있으나 그 협의의 효력과 범위에 대한 규정이 명확히 할 필요가 있다. 둘째로 평생학습관의 설치‧운영 권한이 그 이름이 같음에도 불구하고 교육감과 기초자치단체장 모두의 권한으로 되어 있어 혼란을 줄 수 있고, 행정적 낭비요소가 되기도한다. 평생학습관의 설치‧지정은 교육감이, 운영은 교육장이, 평생학습센터의 설치‧운영은 기초자치단체장이 하도록 해야 한다. 셋째로 시‧도별 평생교육협의회를 운영함에 있어 헌법상의 교육의 전문성을 실현하기 위해서는 협의회를 교육감 소속하에 두는 것이바람직하다. 넷째로 학교개방에 관한 규칙은 학교장이 정하도록 해야 한다.
Abstract
I studied on the problem and improvement plan of lifelong education law in point of educational autonomy and local autonomy. The role of local government is important in lifelong education. And the lingkage between local educational government and local general government is important. The present law of lifelong education has a few problem. Firstly, the effect and scope are not clear in making the plan of lifelong education implemnt. Secondly, the authority on establishment of lifelong study institute is given to the superintendent of education and the primary local governmnet mayor. It cause the confusion and waste of administrating the organization. Thirdly, council for the lifelong education is belong to the local government. It can go against the constitutional spirit of educational professionalism.
