교육위원회의 지방의회 흡수·통합을 포함한 지방교육자치제의 폐지라는 극단의 안까지 등장하고 있는 시점에서 지방교육자치제가 정착되는데 어떠한 문제점 때문에 또 수 차례에 걸쳐 이루어진 제도적·법적 수정 보완이 어떠한 의미를 가지는지에 대한 고찰이 필요하다. '지방교육자치에관한법률'은 지방교육자치제도의 실시에 근간이 되며, 그 속에 지방교육자치의 이념을 반영하고 있다. 본 연구는 '지방교육자치에관한법률' 개정이 지방교육자치가 표명하고 있는 교육자치와 주민자치라는 이념에 얼마나 근접하고 있는가를 분석하고자 하였다. 그 결과 지방교육자치에관한법률의 개정과정은 지방교육자치가 표명하고 있는 이념 구현과는 다소 거리가 있는 것으로 분석되었다. 특히, 교육이 가지는 전문성에 대한 간과는 지방교육자치제의 존속의미를 흐리게 하고 있다고 할 수 있다.
Abstract
The purpose of the study is to analyze how does the revision of ‘law of local educational autonomy' close to ideology such as educational autonomy and resident autonomy in local educational autonomy system is manifesting. In the time that extreme idea like the abolition of local educational autonomy system including the integration of educational board into local assembly appears, it needs to explore there are some problems in the fixation of local educational autonomy system and what is the meaning systematic and lawful change or revision has. 'Law of local educational autonomy' become the basic framework of performing local educational autonomy system. The result of the study shows that the revisional process on law of local educational autonomy has a little distance from the realization of ideology educational autonomy system manifests. In particular, the failure of taking a look at the specialization education has makes the meaning of local educational autonomy system continues to exist indistinct. Based on the result, some issues related to the ideology of local educational autonomy system are discussed.
