사립학교의 책무성: 자주성과 공공성의 조화

책무성 개념은 교육개혁위원회의 5.31 신교육체제 구상을 통해 대두되면서 교육제도 운영의 기초로서 전문성의 틀을 대치하는 대안으로서 부각되었고, 교원 개개인의 능력과 의지의 차원이 아니라 학교라는 기관 차원에서 교육에 대한 사회적 불만을 반영하고 있었다. 사립학교의 책무성에 대한 검토는 사립학교의 3면적 지위에 대한 이해에서부터 시작하여야 한다. 사립학교는 교육기관으로서 지위, 사립학교로서 지위, 면세혜택자로서 지위라는 3가지 지위를 가지고 있으며, 각 지위에 따른 책무성은 서로 다른 성격을 갖는다. 책무성 논의의 핵심은 사립학교로서 지위에서 갖는 책무성으로 바로 사학의 자주성과 공공성의 가치가 서로 갈등을 빚을 수 있기 때문이다. 사학으로서 다양하고 특색 있는 교육을 하기 위해서는 사학의 자주성이 강하게 보장되어야 하지만, 높은 사학의 비중을 고려할 때 공교육을 분담하는 사학의 공공성에 따른 자주성의 제한이 불가피하다. 다만, 대학은 초·중등학교와 다른 고도의 자율성이 보장되어야 하고 헌법에서도 이 점을 선언하고 있는 만큼 자주성과 공공성의 가치를 조정할 때 자주성 쪽에 더 가치를 두어야 한다. 책무성의 확보 장치에 관해서 보면 가장 자주성에 대한 침해가 큰 경영 구조 접근법에서부터 가장 개입이 약한 시장 조정 접근법까지 6가지 접근법을 상정할 수 있는데 최근 국회에 제출된 사립학교법 개정안은 경영 구조 접근법을 취하고 있다. 책무성 확보 장치로서 무엇을 선택하든지간에 그러한 대안이 계속적으로 실질적인 효과를 거두기 위해서는 책무성 이행에 대한 인센티브가 같이 결합되어야 한다.
Abstract
When traditionally the frame of professionalism in the education has prevailed, the critical issues focused on the improvement of teachers' professional capacity. Meantime in 1995, when the Presidential Commission on the Educational Reform suggested the change of pivot in essential values from educational agency's initiatives to comsumer-centered system, the educational system have met new demands and concepts for educational accountability. The movement of accountability did not make a problem of teaching ability in the level of individual teachers, but rather it contained social mistrust on the present total management of educational services. Private schools especially have been attacked from parents groups because they were regarded as ignorant of public interests. Private schools have a purpose of supplying a variety of valued educational services, while public schools have an obligation to supply a open general education to secure an equity of educational opportunities. The autonomy for plentiful education and the public interest don't logically coincide respectfully. The adequate balancing of the two values is requested in the current situations. apart from elementary and secondary schools, the higher education is entitled to enjoy the autonomy rather than duty for public interests in the light of its characteristics. Recently, the ruling party issued a bill of revising of Private Schools Act. The essence of the bill is to restructure the governing body by mandatorily electing a certain number of the representatives of faculty. It is likely to restrict the autonomy of private schools, so it provoked social severe debates. It is reasoned that the bill is to be redeemed unconstitutional when it goes beyond the rational point, and overrides the Constitutional fundamental rights of private schools.
