Abstract

Since the shootings at Columbine High School near Littleton, Colorado in the year of 1999 and the incidents of school violence have drawn increased attention to bullying and harassment in the United States of America, state and federal government started to enact federal and state laws and statutes addressing bullying in schools. The thirty-three states in the United States enacted laws concerning anti-bullying. Among them twenty-two states expressly define ‘bullying.’ Even two states do not use the term ‘bullying.’ Nine states require anti-bullying policies without defining bullying. The definitions of ‘bullying’ or ‘harassment’ depend on each state. There are two notable points concerning anti-bullying laws in the United States. First, a school employee, or student, or a student’s parent or guardian who reasonably and in good faith reports an incident of harassment or bullying shall be immune from civil or criminal liability relating to such report. Second, although there is no federal law against bullying per se in the United States, victims of bullying can make a claim for damages under federal laws relating that prohibit harassment.
