2004년에 제정된 후 2025년까지 35차례의 크고 작은 개정을 거듭해 온 학교폭력예방법에서 주요한 변화와 강조점을 살펴보았다. 개정 내용에 관해 무엇이 문제가 되었는지를 검토하고, 윤리적 혹은 교육적 논란이 있는 주요 쟁점들을 13가지로 정리하였다. 변화의 거시적 흐름에서, 초반에는 학교폭력 개념의 구체화에 관련된 개정들이 많았고, 중후반에는 학교에서의 사안처리 절차의 정교함 및 관련 주체들의 책임에 관련된 개정들이 많았다. 최근에는 학교 현장의 업무 부담을 줄이고, 사안 처리에 관한 책임을 상급 기관으로 이관하려는 노력들이 나타나고 있다. 앞으로는 아동학대법과의 관계 정립이 중요한 과제로 떠오를 것으로 전망한다.
Abstract
Focusing on the School Violence Prevention Act, which was enacted in 2004 and has undergone 35 major and minor revisions until 2025, This study examined what changes have been made and what has been emphasized. I analyzed the issues raised during the rivision process and identified 13 key ethical and educationally controversial issues. Looking at the flow of change in macro scale, early revisions primarily focused on defining and clarifying the concept of school violence, while later revisions focused on refining of school case handling procedures and the responsibilities of relevant stakeholders. Recently, efforts have been made to reduce the workload on schools and shift responsibility for case handling to higher-level authorities. I also argued that establishing a clear relationship between School Violence Prevention Act with the Child Abuse Punishment Act is expected to emerge as an urgent task.
