학교폭력 예방을 위한 사이버불링(Cyberbullying)에 대한 연구: 미국의 법적 대응의 특징과 법제 도입을 위한 검토를 중심으로

본 연구는 국내에서는 생소한 사이버불링의 개념을 정의하고 있다. 기존의 사이버폭력과의 차이를 설명하고 SNS와 결합된 사이버폭력이 사이버불링으로 나타나 어떠한 특성을 가지고 현재 사회적으로 문제가 되고 있는지에 대하여 논하였다. 이러한 문제들을 해결하기 위하여 미국의 사이버불링 법제의 대응에 대하여 살펴보고 각 중에서 사이버불링에 대한 대응을 어떻게 하고 있는지를 비교법적으로 연구를 진행하였다. 또한 이러한 연구안에서 미국 사이버불링 법제의 특징을 살펴보았고 이러한 특징을 중심으로 국내에 도입을 위한 검토를 진행하였다. 결과적으로 본 연구는 국내에서는 생소한 사이버불링의 개념을 소개하고 앞으로 사이버불링과 관련된 입법의 기초자료의 구축을 위한 목적을 가지고 있다.
Abstract
This article argued about Cyberbullying seen in internet communication by referencing preceding Cyberbullying studies in USA. Cyberbullying usually means that the repeated use of modem technologies including e-mail, instant message, blogs, chat rooms, pagers, cell phones to harass, threaten or intimidate others. Cyberbullying is the use of the Internet and related technologies to harm other people, in a deliberate, repeated, and hostile manner. As it has become more common in society, particularly among young people, legislation and awareness campaigns have arisen to combat it. The number of victims of cyberbullying is increasing and the issue of cyberbullying has been drawing attention but there is no independent laws regarding cyberbullying thus cyberbullying is being regulated by many different parts of other relevant laws. The purpose of this article is to seek implication from the enacting experience of the USA, for implementation of policy and enactment of cyberbullying law.
