본 논문은 대한제국기의 정부 공식 법전인 「法規類編」의 편찬과 간행에 관하여 분석한 것이다. 1876년의 문호 개방 이후 국권이 피탈된 1910년까지 편찬된 근대 법률서 및 법률 관계 자료에 대한 종합적 고찰을 시도하였으며, 이를 토대로 종합법전인 「法規類編」을 주요 구성요소로 하는 ‘大韓帝國 法典 體制’라는 대한제국기 법전 및 법제 구성에 관한 새로운 해석을 제시하였다. 또한 「法規類編」의 편찬 및 간행 과정, 배포에 대하여 분석하였다. 주무부처인 內閣(議政府)은 기존의 「官報」 게재 법령을 중심으로 「法規類編」 수록 내용을 편찬하고 공문 수발신을 통한 타 부처와의 긴밀한 협조로써 이를 보완하였으며, 계획적 간행과 관청 배포, 판매를 추진하였다. 이 연구는 대한제국기 정부의 공식 법전으로서 지속적으로 편찬된 「法規類編」에 관한 본격적 분석을 시도한 첫 번째 연구라는 점에서 의의가 있다.
Abstract
This paper examined the compilation and publication of Beopgyuyupyeon (法規類編), the official code of the Korean Empire. A comprehensive review of legal books and legal materials compiled during the modern period of Korea was attempted, and a new interpretation of the legal code and legal system of the Korean Empire, called the ‘Korean Empire Legal Code System’ (大韓帝國 法典 體制), was suggested based on it. Beopgyuyupyeon is a major component of ‘Korean Empire Legal Code System’. Also, the compilation and publication process of Beopgyuyupyeon were examined. The Cabinet (內閣) compiled contents of Beopgyuyupyeon focusing on existing laws and statutes published in Gwanbo (Government Gazette), supplemented them through close cooperation with other ministries by exchanging official documents, and promoted planned publication and distribution. This paper is significant in that it is the first study to attempt an examination of Beopgyuyupyeon.
