우리 사회에서 연명의료 중단을 포함하여 안락사 및 존엄사와 관련된 많은 찬반 논쟁에 의료계, 법조계, 종교계, 환자 단체 등이 참여하였지만, 각각의 입장이 합의에까지 이른 것 같지는 않다. 무엇보다도 안락사, 존엄사, 연명의료 중단과 관련된 논의에서 이 논의에 의하여 가장 영향을 받을 수 있는 장애계가 배제되어 왔고, 이 이슈와 관련하여 장애계에 의하여 수행된 연구도, 이 이슈를 장애와 연관 지어 논의한 연구도 전혀 없었다. 이에 본 연구에서는 안락사의 유형을 구분함으로써 현재 혼용되고 있는 용어들의 개념을 살펴보고, 연명의료 중단의 정당성의 근거에 관한 논리 및 국회에서 제정된 연명의료결정 법률의 내용을 검토한 후, 이어 연명의료 중단의 부당성의 근거에 관한 논리 및 법률의 오류를 제시하고자 한다. 끝으로 장애인 안락사에 대한 장애인의 관점의 토대 위에서 인간의 사망 시기의 인위적 단축과 관련하여 본 연구의 결론을 도출해 보고자 한다.
Abstract
The medical community, legal community, religious community, and patient groups have taken part in many arguments for and against euthanasia and ‘death with dignity’ including the withdrawal of life-prolonging treatment in our society, but they do not seem to reach an agreement. Above all, the disability community likely to be affected the most by the debate over euthanasia, death with dignity, and the withdrawal of life-prolonging treatment has been excluded from this debate, and there was no study that was conducted by the disability community on this issue and that associated this issue with a disability. Hence, this study looks into the concept of the terms currently used together by classifying types of euthanasia, and examines the logic forming a basis for the rightness of withdrawing life-prolonging treatment and contents of an act on decisions about life-prolonging treatment. Then it presents the logic forming a basis for the wrongness of withdrawing that treatment and errors in the act. Lastly, it draws the conclusion of this paper relating to the artificial reduction of the time of human death on the basis of disabled persons’ viewpoint on euthanasia for them.
