본 연구는 보호고용된 장애인의 근로자성을 최근 서울행정법원의 판결과 이론적 논의들을 통해 규명하였다. 현행 장애관련법은 보호고용된 장애인의 근로자성을 규정하고 있지 않으나, 최근 서울행정법원이 보호작업장에서 근로하는 장애인의 근로자성을 인정하는 판결을 선고하였다. 동 판결이 보호작업장에서 근로하는 장애인의 근로자성을 최초로 인정했다는 의의에도 불구하고, 최저임금적용제외의 문제는 여전히 남아있다. 외국의 사례와 이론적 논의들에 비추어 볼 때, 중증 장애인 고용정책에서 보조금고용을 통한 최저임금 보장을 수반하는 근로자성 인정이 필요하다 하겠다.
Abstract
This study attempts to examine the concept of workers with disabilities in sheltered employment policy. Disability Law in Korea does not state it, but recently the Seoul Administrative Court makes a decision that workers with disabilities in sheltered employment can be seen as a regular laborer. Although the court admits workers with disabilities belong to the category of a laborer, there is limitation that workers with disabilities in sheltered employment policy are exempted from minimum wage legislation. Considering other national situations and many discussions, there is a call for workers with disabilities in sheltered employment policy to receive minimum wage protecting by way of subsidized employment.
