최저임금제도는 근로자 임금의 최저수준을 보장하는 것이지만, 장애인근로자는 적용이 제외될 수 있다. 최근 고용노동부는 장애인근로자의 작업능력평가 결과에 따라 최저임금의 일정 비율을 감액하는 제도의 도입을 추진하고 있다. 이러한 제도 도입 논의에서 핵심은 장애인근로자에 대한 작업능력평가 방법이라 할 수 있다. 본 연구에서는 최저임금 적용제외 제도에 따른 현행 우리나라 작업능력평가의 현황과 문제점을 짚어보고, 일본, 미국, 호주의 작업능력평가와의 비교분석을 통해 시사점을 도출하였다. 특히 외국과의 비교를 통해 작업능력평가의 객관성과 정밀성을 개선하기 위한 방안을 구체적으로 제시하였다. 본 연구를 바탕으로 장애인 최저임금 감액적용 제도가 국내에 도입될 경우 그에 합당한 작업능력평가의 제도 개선 방향성을 정립할 수 있기를 기대한다.
Abstract
This study aims to examine the wage assessment process for employee with disabilities in three countries: Japan, United states and Austalia. The Minimum Wage Act shall apply to all businesses or workplaces employing workers but employers can pay less than the minimum wage to worker who has remarkably low abilities to work due to a mental or physical handicap by the exclusion permission from Minister of Employment and Labor. Recently Ministry of Employment and Labor(MOEL) announced introduction of commensurate wage based on the vocational ability assessment of employees with disability. So we attempt to find out the improvement plan of wage assessment process through this review. The available information on the three countries’ process will make recommendations for improving wage assessment of Korea. Based on this study we hope a few considerations about wage assessment of worker with disabilities which should be pay attention in the vocational evaluation field.
