장애인 고용정책의 개선방향에 관한 연구 - 「장애인고용촉진 및 직업재활법」과 「장애인차별금지 및 권리구제 등에 관한 법률」을 중심으로 -

장애인이 누군가의 도움을 받아야만 하는 존재로 머무르지 않고, 스스로의 자립을 실현하고 궁극적으로 더불어 살아가는 사회공동체의 일원이 되게 하기 위해서 장애인 고용은 필수적이다. 노동을 통한 직업생활은 장애의 유무를 떠나 모든 사람에게 개인의 인간적인 삶을 위한 큰 부분을 차지한다. 따라서 장애인의 인간다운 삶을 위해 국가는 다양한 정책적 노력을 기울이는 등 그 보호 의무를 다해야 한다. 이를 위해 여러 국가는 장애인의 노동시장 통합과 사회보장을 중심으로 정책적 노력을 기울이고 있다. 장애인 고용의 목적은 장애인 스스로 자립할 권리를 실현하는 데 있다. 일을 통한 경제적 자립만큼이나 노동을 통한 창조적인 능력발휘와 인격체로서의 자아발현은 중요한 의미를 갖는다. 따라서 노동은 장애인의 완전한 사회참여와 평등을 가능케 함으로써 진정한 사회통합을 이루는 수단이 된다. 장애인으로 하여금 사회공동체에서 주변인이 아닌 주체성을 가진 능동적 참여자로 진정한 자립을 기할 수 있게 하고, 궁극적으로 더불어 살아가는 사회공동체를 이루어가는 것은 우리에게 주어진 과제이다. 우리나라는 장애인 의무고용제를 기초로 장애인의 고용을 통한 사회통합을 위한 법률과 정책수단을 발전시켜 왔다. 그러나 여러 제약적인 요건과 인식부족 등의 이유로 장애인의 노동시장 배제문제는 여전히 큰 문제로 남아 있다. 장애인차별금지법의 제정으로 모든 생활영역에서의 장애를 이유로 한 차별이 금지됨에 따라 장애인 고용문제는 차별금지의 법리로도 접근하게 되었다. 이로써 장애인 고용문제에 있어서 결과 평등을 지향하는 의무고용제와 기회 평등을 지향하는 차별금지의 법을 두고 있는 상황에서 이 두 법의 관계에 대해 생각해 볼 필요가 있다. 궁극적으로는 어떤 고용정책이 장애인의 복지와 사회활동 참여증진을 통하여 사회통합에 이바지하는지를 연구해야 할 것이다.
Abstract
Person with disabilities with the help of someone not adsorbed to the present , and ultimately achieve self-sufficiency of their own lives as well as members of communities is essential in order to get the disability employment. Through labor and professional life to all who fail to leave the presence of individual human life accounted for the largest portion. Therefore, the human life of people with disabilities and paying for the country, including the various policy efforts to exert its protective duties. many countries labor market integration of persons with disabilities and social security policy is committed to focusing on. The purpose of employing person with disabilities to realize their own rights are self-reliant. Economic independence through job creation through labor as much as the ability to exert self-expression as a person has important implications. Thus, the full social participation of labor and equality of persons with disabilities by enabling truly is a way to achieve social integration. Person with disabilities in their communities to contribute actively with non-identity to be able to tell the true self-sufficiency, and ultimately living communities in addition to the challenges given to us is not going to occur. On the basis of "Quota System" employment duties through the employment of disability Act and policy measures for social integration has been developing. But as many restrictive requirements for reasons such as lack of awareness of disability issues preclude the labor market still remains a big problem. Enactment of the “Disability Discrimination Act”, all living in the area of disability discrimination prohibited by reason of disability as a non-discrimination in employment matters as judicial was approached. This results in "Quota System" employment equality and equal opportunity oriented towards of employment “Disability Discrimination Act” of the place in a situation where both need to think about the relationship. Ultimately, any employment policy, welfare and social participation of person with disabilities through the promotion of social integration will contribute to the need to study.
