정체성의 교차와 포괄적 차별금지법 - 포괄적 차별금지법이 '복합차별' 사례에 대해 갖는 의미

2006년 이후 지금까지 포괄적 차별금지법 제정 요구가 이어지고 있다. 포괄적 차별금지법이 제정되어야 하는 가장 중요한 이유는 개인에게 차별사유들이 중첩해 있다는 것이다. 인종, 성별, 장애 등 차별 사유를 각각 다루는 개별적 차별금지법으로는 복합적 사유로 차별당한 사람들을 적절히 이해하고 구제하기 어렵다. 복합적 차별사유를 다루기 위해 포괄적 차별금지법에는 ‘복합차별’ 금지 조항을 넣기도 한다. 이 글은 교차성의 개념화와 확산에 대한 고찰을 통해 차별 사유의 중첩성을 조명하고, 포괄적 차별금지법의 적용에서 복합적 사유의 차별사례들이 어떻게 다루어졌는지에 대한 외국의 경험을 탐색하였다. 이를 통해 포괄적 차별금지법의 제정이 필요할 뿐 아니라, 법의 적용 과정에서 개인이 경험한 차별사유의 복잡성, 사회적 구분(social division)에 따른 사회적 범주 간의 지배-권력관계, 소수집단에 대한 억압의 역사를 심층적으로 고려해야 함을 논의하였다. 이 글의 결론 및 제언은 다음과 같다. 첫째, 차별사유의 복합성을 고려하면 우리나라도포괄적 차별금지법을 제정해야 하고, ‘복합차별’ 조항을 명시함으로써 차별 사유의 복합성에 대한 사회적 인식을 높일 필요가 있다. 둘째, 포괄적 차별금지법을 통해 복합차별 사례를 분석하고 구제할 때, 이를 단일 축 차별로 환원하거나 단일 축 차별의 단순한 덧셈으로 취급하는 것이 아니라, 교차성 관점에서 적절히 분석하고 구제할 수 있어야 한다. 교차성 관점이란 불평등을 야기하는 범주간 권력관계 및 억압의 역사라는 맥락에서 정체성의 교차가 차별에 상승작용을 일으키는 요인임을 세밀하게 분석하는 것이다. 끝으로, 탐색적 수준을 넘어 논의를 정교히 하기 위해, 각국의 법체계를 고려한 복합차별 판례에 대한 분석과 함께, 우리나라의 복합차별 사례들이 개별적 차별금지법 체제에서 어떻게 분석되었는지에 대한 좀 더 면밀한 연구와 논의가 이어져야 한다.
Abstract
Since 2006, there has been a demand for the enactment of a comprehensive anti-discrimination law. The reason why the Comprehensive Anti-Discrimination Act should be enacted is that there are multiple grounds for discrimination in individual discrimination case. The multiple discrimination clause of the Comprehensive Anti-Discrimination Act is intended to address the overlap of grounds for discrimination. This article sheds light on the overlap of grounds for discrimination through the concept of intersectionality, and examines the practical way in which the anti-discrimination law system handles complex discrimination through cases of discrimination in foreign countries. Through this, it was discussed the importance of considering the complexity of grounds for discrimination, the power relationship between categories according to social division, and the history of oppression against minority groups in the judgment and remedy of discrimination. The suggestion of this article is as follows. First, a comprehensive anti-discrimination law should be enacted, and multiple discrimination clauses should be specified therein. Second, rather than reducing complex discrimination to single-axis discrimination or treating it as simple addition of a single axis, multiple discrimination should be able to properly analyze and remedy from the viewpoint of intersectionality. The intersectionality perspective is to analyze in detail that the intersection of identities acts as a synergistic factor in discrimination in the context of the history of oppression and power relations between categories that cause inequality. To this end, more in-depth research and discussion on how Korean courts analyze and remedy cases of multiple discrimination should be continued.
