국제상사분쟁의 해결과 국제상사법원- 싱가포르 국제상사법원을 중심으로 -

초록

국제상사분쟁의 가장 기본적이고 원칙적인 해결방법은 특정 국가의 법원에 의한 것이지만 계약 당사자 사이에서 상대방 국가의 법원에 대한 불신이나 상대방 국가의 낯선 법체계 등으로 인해 소송을 통한 분쟁해결보다는 중재와 같은 대체적 분쟁해결수단이 보다 선호되고 있다. 그러나 국제상사중재가 가지는 절차지연이나 비용의 문제, 불복절차가 존재하지 않는다는 문제, 제3자의 절차참가가 곤란하다는 문제, 중재판정의 일관성 부족과 같은 문제가 지적되면서 그 대안으로 국제상사분쟁을 전문적으로 처리하는 런던 국제상사법원과 같은 국제상사법원이 제시되었다. 그 중 싱가포르 국제상사법원(Singapore International Commercial Court, SICC)이 비교적 최근인 2015년에 개원하였는데 짧은 역사에도 불구하고 잘 정비되고 합리적인 절차와 전문적인 재판부 구성, 신속한 절차 등을 이유로 점점 더 많은 국제상사분쟁 당사자들이 이용하고 있는 추세이다. 우리나라도 최근 중재산업 진흥에 관한 법률을 제정하는 등 국제상사분쟁에서 동아시아의 법률허브로서 자리매김하기 위한 다양한 노력을 하고 있는데, 이와 같은 시점에서 SICC의 지위와 분쟁해결절차 등을 살펴보는 것은 우리가 나아가야 할 바를 정하고 우리의 강점과 약점을 파악하는데 있어 유효한 시사점을 제공해줄 수 있을 것이라고 생각된다. 이 글은 우선 SICC의 설립 및 그 지위에 대해 먼저 보고 SICC에서의 분쟁해결절차에 대해 개관하였다. 다음으로는 SICC가 지금까지 내린 판결 중 중요성이 있다고 생각되는 것을 선별하여 그 내용을 분석하였고, 마지막으로는 SICC가 가지는 특징 내지는 강점에 대해 분석하고 이에 근거하여 그러한 특징 내지 강점이 우리에게 어떤 시사점을 줄 수 있는지에 대해 살펴보았다.

Abstract

Singapore has developed a formidable transnational duspute resolution hub. In January 2015, Singapore established Singapore International Commercial Court(SICC) which was specifically designed to hear inter- national commercial disputes. The purpose and ambition of establishing the SICC is to attract high value disputes and to provide corresponding dispute resolution and legal services. For this, the SICC has its own procedural rules and practice directions. This paper aims to examine the structure, rationale of the SICC and its procedures. And this paper also aims to analyze some case experience of SICC. Based on this analyzation, this paper will discuss some key features and benefits of SICC and propose some implication to our international commercial dispute resolution system.
