Abstract

Punitive damages have been increasingly subject of debate among legislators, lawyers, and academics in South Korea in recent years. Based on the U.S. model, arguments favoring the introduction of punitive damages focus on the deterrent function of punishment. By contrast, the opponents of punitive damages argue that they are an anomaly, and that they confuse the civil and criminal functions of the law. In addition, they express concerns about the excessiveness and unpredictability of punitive damage awards. As in South Korea, legal formalism that flourished in the United States between 1885 and 1940 emphasized a clear separation between public law and private law. During the period there was a vigorous debate on punitive damages. However, the debate ended in a victory for the more practical approach respecting stare decisis over the more theoretical and dogmatic approach. In recent years, the excessiveness and unpredictability of punitive damage awards have led to tort reform in individual states in the field. Many jurisdictions have taken diverse measures to constrain punitive damages, including three basic built-in controls: the state of mind requirements, jury instructions, and post-verdict excessiveness review. This article explores the implications of the introduction of punitive damages for South Korea based on the U.S. experience in this field.
