Abstract
Under the new adult guardianship system, limited guardianship is designed to make the most of the remaining capacity of a limited guardian and to respect his autonomy. After the scope of the act of saving consent is determined, the scope of obtaining the guardian's consent in real life and the scope that the guardian can represent can cause procedural complexity and confusion in practice. Financial institutions imposed significant restrictions, such as requiring the consent of a limited guardian to financial transactions of a limited guardian, and a recent Supreme Court ruling determined that this was a violation of the Act on the Prohibition of Discriminati on against Persons with Disabilities and ordered the payment of alimony. However, alternatives prepared by the Financial Services Commission still appear to be insufficient to supplement the safety of transactions and ensure clarity of practice, largely due to the rigidity of the guardianship system. In this paper, we looked at the decision-making support system, which has emerged as an alternative to the guardianship system, focusing on the laws of the United States. In recent years, the use of the decision-making support system is increasing in the United States as criticism of the existing guardianship system has increased. In the case of a limited guardianship sentence to alleviate the side effects of uniformly limiting the guardian's ability to act through a guardianship trial, it is difficult to confirm the scope of the ward's ability, and there is a concern that the transaction itself may be avoided due to the risk of the counterparty. Therefore, in this paper, the decision-making support system was reviewed as a supplementary measure for the guardianship system. If the ward can draw up a decision-making support agreement and confirm to the other party his or her complete ability, that is, the validity of the legal action, to a certain range of transactions, it is expected that the problems revealed in the target judgment can be solved.
