경찰의 드론 활용에 따른 형사법적 문제

새로운 과학기술의 등장은 우리의 삶에 풍요로움을 주기도 하지만, 반대로 예상하지 못하는 문제로 인하여 고통을 주기도 한다. 군사용으로 개발된 드론(Drone)은 우리의 모든 생활 영역과 밀접한 관계를 맺고 있다. 이러한 드론은 필요한 기계장치 중의 하나로 인식하고 있으며, 그 시장규모도 점차 확대되고 있다. 이러한 드론은 재난현장, 실종자 수색, 마약수사 등 다양한 분야에서 활용하고 있으며, 그 활용의 가치는 높다고 할 수 있다. 이와는 반대로 예를 들면 드론을 이용한 촬영으로 인한 개인의 사생활 침해 문제, 개인 주거에 침입하는 문제 그리고 테러에 활용되는 등 여러 문제가 있을 수 있다. 현재 드론은 2019년 4월 30일 법률 제16420호로 제정되고 2020년 5월 1일부터 시행되고 있는 「드론 활용의 촉진 및 기반조성에 관한 법률(이하 ‘드론법’이라 한다)」에 그 정의 규정을 가지고 있다. 그러나 드론을 직접적으로 규율하고 있는 것은 「항공안전법」이지만, 수사기관의 범죄예방활동이나 범죄수사활동에 드론을 활용하는 경우 명확하게 이를 규율하는 규정은 존재하지 않는다. 이로 인해 경찰활동 영역에서 드론을 활용하는 과정에서 오⋅남용이 있다면 이를 통제할 수 없는 문제가 발생하게 된다. 우리 형사사법 법제에서 법집행기관에서 드론을 활용할 경우 이를 직접적으로 규율할 수 있는 근거 법률은 없다. 이러한 문제를 해결할 수 있는 방안으로 첫째, 기존 법률에 관련 규정을 신설하는 방식, 둘째, 새로운 법률을 제정하는 방식, 셋째, 기존 법규범 틀 속에서 해석하는 방식 등으로 제시할 수 있다. 특히 새로운 법률을 제정하여 통제하려는 시도들이 있었지만 이루어지지 않았다. 이들 제시방안은 나름의 장단점을 지니고 있다고 평가할 수 있다. 현재의 상황에서 결국 기존의 법규범 틀 속에서 해석을 통하여 수사기관의 드론 활용에 대한 허용범위와 요건을 설정해야 한다. 이러한 과정을 통하여 수사기관의 드론 활용에 적법성을 부여할 수 있을 것이며, 그 위험성도 제거가 될 것이다.
Abstract
New science technology has brought us affluence, yet on the other hand, it also has caused pain with unexpected problems. Drones developed for military purposes are closely related to all the realms of our life. These drones are being regarded as one of necessary mechanical equipments, and the size of their market is gradually increasing. These drones are being used in various fields, such as disaster scenes, search for a missing person, narcotic investigation and etc., and they can be said to be very useful. On the other hand, drones have different problems, for example, the invasion of an individual's privacy by filming a person using a drone, housebreaking and use in a terror. At present, drones have their regulation of definition in the 「Act on the Promotion and Foundation of Drone Utilization(‘the Drone Law’ from hence)」 which was enacted as the 16420th law on April 30, 2019, and began to be enforced since May 1, 2020. Yet, while the 「Aviation Safety Act」 directly regulates drones, there is no regulation to clearly control drones in case drones are used for the activities to prevent or investigate crimes by investigation authorities. Because of which, if drones are abused in the process of using drones during the activities of the police, the problem that drones cannot be controlled can occur. In the Korean criminal justice legal system, when drones are used by law enforcement agencies, there are no ground laws that can regulate them directly. As the ways to solve those problems, first, the establishment of new provisions of the existing laws, second, the establishment of new laws, third interpretation in the frame of the existing laws and regulations and others can be suggested. In particular, control with the enactment of new laws has been tried, but it has been failed. The suggestions can be estimated to have their own merits and demerits. In conclusion, in the present situation, the acceptable range and requirements for the use of drones by investigation agencies need to be set through the interpretation in the frame of the existing laws and regulations. Through this process, the legitimacy of the use of drones by investigation agencies will be able to be granted, and its danger will be removed.
