젭슨 청구항과 관련하여 3가지 의문이 제기되는 바, 첫째 젭슨 청구항의 형식이 무엇인지, 둘째 젭슨 청구항의 전제부에 기재된 내용을 공지기술로 인정할 수 있는지, 셋째 젭슨 청구항의 전제부를 제외하고 해석할 수 있는지가 그것이다. 먼저 젭슨 청구항이 어떠한 형식의 청구항인지에 대해, 단순히 청구항의 형식이 전제부와 특징부로 나누어 기재되어 있다고 하여 모두 젭슨 청구항을 나타내는 것이 아니라 전제부에는 종래기술이 기재되어야 하고 특징부에서는 종래기술로부터 개량되거나 신규의 요소가 기재되어야만 젭슨 청구항이 되는 것이다. 다음으로 젭슨 청구항의 전제부에 기재된 내용을 공지기술로 인정할 수 있는지에 대해, 젭슨 청구항의 전제부의 해석을 특별한 사정이 없는 경우 전제부의 구성요소가 공지기술임을 추정하고, 전제부가 동일 발명자의 공개되지 않은 발명을 인용했다거나 아니면 신규성을 상실하지 않았다는 것을 입증하는 등 특별한 사정이 있거나 별도의 반증이 있으면 이 추정을 번복하는 식으로 해석하는 것이 젭슨 청구항의 역사적 도입 취지, 특허출원인의 젭슨 청구항의 작성의도, 심사관의 젭슨 청구항에 대한 심사실무 등과 합치되므로 타당하다. 또한 발명의 진보성을 판단할 수 있는 자료는 출원전 공개된 모든 기술내용이므로 젭슨 청구항의 전제부에 기재된 내용이 공지기술로 인정된다면 별도의 증거자료 없이 이를 인용하여 젭슨 청구항 전체의 진보성 등 특허성을 판단하는 것이 당연하다. 다음으로 젭슨 청구항의 전제부에 기재된 구성요소는 공지기술이므로 이를 제외하고 해석해야 한다고 주장하는 경우가 있으나 이는 구성요소가 공지된 청구항의 해석에 대한 기본법리에 대한 이해의 부족에서 기인하는 것이라 받아들여질 수 없다고 판단하였다.
Abstract
There are 3 issues concerning the interpretation of a Jepson claim. The first is what the form of the Jepson claim is. The second is whether the preamble of the Jepson claim can be admitted as prior art. The third is whether the preamble of the Jepson claim defines the claim. First, the Jepson claim includes: (1) a preamble with a general description of the elements or steps that are conventional or known, (2) a characterized part with the elements the applicant considers new. So a claim divided into 2 parts like a preamble and a characterizing part without having conventional or known elements in the preamble whould not be treated as the Jepson claim. Second, the subject matter recited in the preamble of the Jepson claim is not presumed to be prior art according to Korean case law. However, like the US patent practice, it is more reasonable that the preamble of the Jepson claim is presumed to be prior art and this presumption may be rebutted by a showing that the preamble is not prior art. Because such an interpretation accords to the purpose of the introduction of the Jepson claim, the intention of the applicant, and the Korea patent examination practice. Third, the preamble in a Jepson claim constitutes a limitation for purposes of determining patentability and infringement because an invention is defined as all elements in a claim so it is not permitted to exclude any element in the claim when interpretating claims.
