위탁선거법의 문제점과 개선방안 연구: 공직선거법과 위탁선거법의 차이점을 중심으로

Abstract

This paper seeks to examine the differences in some statutory regulations prescribed by the Public Official Election Act and the Act on Consignment Elections of Public Organizations (hereinafter referred to as the Consignment Election Act), and to study how the electoral system that comes from the differences between the two election laws affects local elections. Although the Public Official Election Act differs in that it selects the representative agencies of the people and the Consignment Election Act is related to the selection of executives representing limited members, the two election laws are consistent in that they aim for equality of opportunity and fairness, which are the core values of the election. In particular, the election of the heads of Nonghyup, Suhyup and Forestry Cooperatives, which is stipulated by the Consignment Election Act, has the largest number of election law violations, and although the number of electors is slightly different, the constituencies are closely related to the local elections because most of the constituencies overlap with those of local governments. Therefore, I would like to present a measure to improve the problem of the Consignment Election Act in that it is confusing in terms of the consistency of election campaigns and regulations that arise from the difference between the Public Official Election Act and the Entrustment Election Act, and the wrong election culture of the union leader election is adversely affecting the election of public officials who elect state institutions.
