Abstract
This study provides a systematic examination of the constitutional framework governing the electoral system and election management in Korea. Elections function as a core mechanism for concretizing the principle of popular sovereignty proclaimed in Article 1 of the Constitution, conferring procedural legitimacy on the creation and renewal of state power, and serving as an institutional foundation for sustaining the constitutional order of a democratic republic. From this perspective, the study first discusses the constitutional inevitability of the electoral system, focusing on the principles of popular sovereignty, democracy and republicanism, representative government, and the guarantee of political rights as articulated in the Preamble and Article 1 of the Constitution. Second, it analyzes how the principles of universal, equal, direct, secret, and free elections, along with the system of state-funded elections, have been institutionalized to secure fairness and equality of opportunity. Furthermore, it reviews existing scholarship and constitutional case law on the concept and essential character of election management, thereby illuminating its constitutional significance as a safeguard for ensuring the freedom and fairness of elections. By comprehensively surveying the electoral system and election management, this study aims to provide a foundational framework for future academic discussion and potential institutional reform.
