Abstract
In representative democracies, election fairness is crucial for the democratic legitimacy of state power. However, the Public Official Election Act presents a structural conflict of interest, as lawmakers who are subject to its rules are also the ones creating them. This situation, where legislators decide on electoral systems and district boundaries that directly impact their political careers, creates an appearance of a conflict of interest, undermining public trust. This study analyzes this structural issue and the limits of current constitutional control. It examines how the legislative process for election law is monopolized by legislators, excluding oversight from other government bodies. Through case studies, including the Constitutional Court's decisions on electoral redistricting, the study argues that the current system of ex-post judicial review is insufficient. Ultimately, the study proposes a new method for constitutional review: relaxing the 'presumption of constitutionality' for laws with an apparent conflict of interest and placing the burden of proof on the legislature. This would compel lawmakers to engage in Evidence-Based Legislation, moving beyond political compromise and self-interest, thereby enhancing fairness.
